    Default Amung boss nahan me pabayrun sa iyahang sala, salary deduction! is it against the law?


    Im working in an aviation industry, prob is among boss before our unit started nag hire 3 ra katao then natambakan ang trabaho, now since natambakan ug paper works daghan nawala na papel and we are now backtracking everything and we couldn't just find everything, na hire ko pagka 4 months na sa among unit. now dghan ug loss and we are pointing out man power problem since we are catering the largest fleet in the Philippines we are in Materials Division.

    now he wants to deduct everything in our salary.

    question there is it legal for him to do that? we all think it was his fault at the first place since wa xa nag invest ug man power and he admitted it man pud.

    i dont know anything about what law maka protect ninyo against that but obviously di na sya maka taronganon, mayta maka kita mog paagi to fight back, sayang ang e.deduct sa inyong sweldo

    Just share my idea but I am not a lawyer...The decision of your boss is a big mistake..But the problem there if he insist. The best thing for you to do is you consult for a lawyer...They know much especially in that case...

    Unfair Labor practice na brod... Wala siya katungod mo deduct since wala mo naka sala. Ang problema ninyo kay walay system ang inyong buhatan mao na daghan nangawala na documents. Dakong binuang na pag deduct sa inyo sweldo. Pwede na ipa konsulta sa Labor department.

    Ang una nimong buhaton, tapukon nimo ang imong mga kauban ug magtalk mo tanan, ipahibalo sa ila na di na mao ang gibuhat sa imo boss, after mo magkasabot tanan, find a way para mapahibalo sa imo boss na di mo uyon sa iya plano, pwede verbal or written note. Kung di mosugot ang imo boss o di ba kaha gidayon dyod niya ang iya plano, adto nalang sa NLRC dapit sa atbang anitas sa fuente osmeņa, pagdala daan mo ug sedula kay requirements na, ireklamo na didto para masakto nang di mao na desisyon sa inyong boss.

    Puwede niyang buhaton pero illegal man na.

    Article 97 of the Labor Code of the Philippines defines wage as the remuneration or earnings, however designated, capable of being expressed in terms of money, whether fixed or ascertained on a time, task, piece, or commission basis, or other method of calculating the same, which is payable by an employer to an employee under a written or unwritten contract of employment for work done or to be done, or for services rendered or to be rendered and includes the fair and reasonable value, as determined by the Secretary of Labor and Employment, of board, lodging, or other facilities customarily furnished by the employer to the employee. Being the compensation of an employee for a hard day’s work, it should not be subjected to deductions other than those authorized by law.
    Our law prohibits employers, on their own behalf or in behalf of any person, to make deductions from the wages of their employees except in the following instances: 1) where the worker is insured with his consent by the employer, and the deduction is to recompense the employer for the amount paid by him as premium on the insurance; 2) for union dues, in cases where the right of the worker or his union to check-off has been recognized by the employer or authorized in writing by the individual worker concerned; and 3) the employer is authorized by law or regulations issued by the Secretary of Labor and Employment (Article 113, Labor Code of the Philippines).
