The high court, voting 13-0, similarly ruled that the Malampaya fund to be used solely for energy-related government projects, barring the president from using the fund's discretionary provision to divert the fund to other purposes.

The court also found releases of the Presidential Social Fund for infrastructure projects without constitutional basis.

DAP funds not savings, SC senior justice says | BusinessWorld Online

Patay ani si Abad ug Pnoy .... kini si SC Justice Carpio mao man jud unta ni ma Chief Justice ... gi birahan na hinoon sila ...

Mr. Carpio also noted the power to realign savings is limited only to the President and cannot be delegated to anyone.

However, in the case of the DAP, there was no written document coming from the Office of the President authorizing the realignment of savings and the stimulus funds’ basis is attributed to the National Budget Circular (NBC) 541, which was issued by the Department of Budget and Management (DBM).

"In other words, the Secretary of Budget and Management realigned but we have not seen a prior approval of the President to realign," Mr. Carpio said

"Only the President can realign, it cannot be delegated even to the executive secretary," he added.

Further, Mr. Carpio said there was no written document pertaining to the DAP in 2011 but realignment of savings amounting to P67 billion allegedly occurred during the year.

In 2012, the DBM had NBC 541, but no similar circular was issued for this year, Mr. Carpio noted.
Nag buot2x ra diay si Abad ani ? or imbento lang dayon nila ang DAP tungod sa pasabog ni Jinggoy ..

Ngita ug lusot ang mga Kawatan .....

CAN A JOINT RESOLUTION AMEND A BUDGET LAW?

Joint Resolution No. 7 itself amends the 2013 General Appropriations Act. It proposes to transfer part of the Special Purpose Fund which is "controlled" by legislators into the President’s Calamity Fund. Can that be legally done through a joint resolution? More directly, can Congress, on its own, amend the General Appropriations Act after it has been signed into law by the President? Obviously not.

Doesn’t Joint Resolution No. 7 constitutes a transfer of appropriations, which is prohibited by law? "No law shall be passed authorizing any transfer of appropriations," says Section 25, paragraph 5 of the 1987 Philippine Constitution.
