regarding sa marriage contract naay error sayop ang name spelling ug ang birthdate sayop sad, sa huwis ni sila nag pakasal akong ig- agaw.my question is.. naa ba moy nailhan lawyer na field niya aning klase nga kaso?i have a friend who is atty but naa siya sa manila ug dili man gud siya familiar,in short dili niya field ba klasing case/kaso..if you are a lawyer unya familiar/field ka or if u know some lawyer na makataban bahin ani ..need name sa office and contact no#

THE FAMILY CODE OF THE PHILIPPINES - FULL TEXT - CHAN ROBLES VIRTUAL LAW LIBRARY

Art. 2. No marriage shall be valid, unless these essential requisites are present:

(1) Legal capacity of the contracting parties who must be a male and a female; and
(2) Consent freely given in the presence of the solemnizing officer. (53a)

Art. 3. The formal requisites of marriage are:
(1) Authority of the solemnizing officer;
(2) A valid marriage license except in the cases provided for in Chapter 2 of this Title; and

(3) A marriage ceremony which takes place with the appearance of the contracting parties before the solemnizing officer and their personal declaration that they take each other as husband and wife in the presence of not less than two witnesses of legal age. (53a, 55a)

Art. 4. The absence of any of the essential or formal requisites shall render the marriage void ab initio, except as stated in Article 35 (2).
A defect in any of the essential requisites shall not affect the validity of the marriage but the party or parties responsible for the irregularity shall be civilly, criminally and administratively liable.

So according sa imong gisibya, ang name raman kaha ug ang birthdate sa "Marriage Contract"
Dili man essential requisite ang Marriage Contract, kung dili ang Marriage license man. Mao ayaw kabalaka kay basin clerical error ra ang maong nakabutang dinha sa ilang marriage contract.

Adto ug asa na nimo nakuha ug ipa correct ng maong sayop.
I secure to ang imong marriage license. Ayaw na diri pangita sa istorya. Adto sa PAO - Public Attorney's Office kung medyo apeke sa money, didto patabang or better seek the advice of a lawyer. Correction ra na siya bro.

As long ang katong nakalista sa formal requisites ug essential requisites, na comply to nila sa managti-ayon. dakong VALID ang ilang kasal. Simple corrections lang ang kinahanglanon ang anang Marriage Contract.

If errors in the entry of the marriage contract, the FAMILY CODE is not the law to refer to. The concerned parties must file in Court a Petition for Correction of Entry, kung asa sila gi kasal didto mo file petition, og didto nalang sad mo pangita abogado kay mahal ang appearance of dri ka cebu kuha atty. for example unya sa davao sila gi kasal (sample lang). ang atty. na file ana petition, then byad ka for publication pod.
