Off topic: Ya, its just sad that the laws favor more of the intruder than the homeowner... Its not easy in a break in situation as everything can happen so fast, until such time that a phaser that can be set to stun is invented, deaths due to defensive shooting is still highly a possibility, no matter how well trained you are...

Taiwanese boat trespasses in Japanese territory, captain arrested

A Taiwanese fishing boat was detained by Japanese authorities as it was caught trespassing in Japanese waters near Ishagaki Island on Tuesday. The captain of the 48.25-ton “Cheng Chang Fa No. 2″ was also placed under arrest, according to the Coast Guard Administration (CGA).

The CGA said that the boat from Kaohsiung was caught by a patrol vessel from Japan’s Fisheries Agency, and that it was operating 46 nautical miles southeast of Ishigaki Island which is 250 kilometers off Taiwan’s east coast. Shipmaster Sun Chu-min admitted that they trespassed and he will be released after paying the fine of 4 million yen. Fisheries Agency Director James Sha said that the boat was trespassing beyond a “temporary law enforcement line” that indicates where Taiwanese fisherman can operate in.

This is the first time that a Taiwanese fishing boat was detained by Japan after the signing of the agreement between the two countries that designates an area in Japan’s exclusive economic zone (EEZ) as a jointly managed water and where reciprocal fishing is allowed. Even though Ishikagi Island is within Taiwan’s 200 mile EEZ, the agreement they signed doesn’t allow Taiwanese fishermen to operate near the Yaeyama Island chain, which includes Ishigaki. The bilateral fishing agreement temporarily put on hold the ownership claims of both countries over the Japanese-controlled Senkaku Islands, known as Diaoyutai in Taiwan. China also claims sovereignty over the resource-rich islands.
