criminal acts as described in Section 1 (d) of RA 7080 in the aggregate amount or total value of at least Fifty million pesos (P50,000,000.00). In addition, any person who participated with the said public officer in the commission of plunder shall likewise be punished.
The criminal acts described in Section 1 (d) are as follows:
1. Through misappropriation, conversion, misuse, or malversation of public funds or raids on the public treasury;
I think you're confused. Plunder can be committed through malversation of funds, but it is still a separate offense to the crime "Malversation of Public Funds". Just because it says malversation in the articles of law doesn't mean its the same thing. Malversation (bailable offense) is defined under Article 217 of the Revised Penal Code. Plunder (non-bailable) is defined by special law (the one you copy and pasted).
Why don't you post a link to an article that says Gwen was charged with Plunder? You said they are charged under the same offense, but they're not. I don't know why you are insisting on this. The information is easily verifiable. If you had done some research, then you would have spared yourself from looking like a fool.
You can also just admit now that you don't know what the f*k you're talking about because every post you make trying to cover up mistakes in your other posts only makes you seem more and more confused... It's OK to admit you're wrong sometimes, alright? It's at least less embarrassing than digging yourself into a deeper hole.
I'll give you a hint why Gwen Garcia wasn't charged with plunder. The amount diverted as charged by the Ombudsman was in the amount of P49,849,200. Read what you copy and pasted and check it against the amount alleged. Hopefully, you'll see why Gwen was charged with the lesser (bailable) offense of Malversation of Public Funds instead of Plunder...
