    Exclamation Fetus not yet a person according to Catholic Hospital


    Canyon City, Colorado (CNN) -- Life begins at conception, according to the Catholic Church, but in a wrongful death suit in Colorado, a Catholic healthcare company has argued just the opposite.
    A fetus is not legally a person until it is born, the hospital's lawyers have claimed in its defense. And now it may be up to the state's Supreme Court to decide.
    Lori Stodghill was 28 weeks pregnant when she went to the emergency room of St. Thomas More Hospital in Canyon City vomiting and short of breath, according to a court document.
    She went into cardiac arrest in the lobby.
    "Lori looked up at me, and then her head went down on her chest," her husband Jeremy Stodghill, said.
    She died at age 31. Her unborn twin boys perished with her. That was New Year's Day 2006.
    Stodghill, left behind to raise their then 2-year-old daughter alone, sued the hospital and its owner, Catholic Health Initiatives, for the wrongful deaths of all three.
    After about two years of litigation, defense attorneys for the hospital and doctors entered an argument that shocked the widower.
    They said that under state law, an embryo is not "person," until it is born alive, according to court documents. The Stodghill's twins were deceased, when they were removed from their mother's lifeless body.
    "I didn't even get to hold them," Jeremy Stodghill said. "I have an autopsy picture. That's all I've got."
    The court agreed with the argument, and Stodghill lost the suit. The court also ruled against Stodghill in the case of his wife for other legal reasons.
    The hospital and doctors sued him for over $118,000 legal fees and attempted to garnish his wages, according to a legal document filed on his behalf.
    The defendants offered to forget the fees, if Stodghill dropped his appeal. He refused and filed for bankruptcy to avoid having to pay the claim, which he says he can't afford as he struggles to raise his now 9-year-old daughter Libby.
    Stodghill has petitioned the Colorado Supreme Court to hear his case, and he'd like to hear from the Catholic Church.
    The Catholic Catholic Bishops of Colorado declined to comment on the legal proceedings but said it will review the litigation and Catholic Health Initiatives' practices "to ensure fidelity and faithful witness to the teachings of the Catholic Church."
    Stodghill wears a tattoo on his chest with his unborn sons' footprints, their names and the words "our sons."
    He wants the church and his state to see them the same way.

    and the owners of Catholic Health Initiatives and board of directors (who might be composed of some priests/nuns) probably didn't even blink at this....

    and of course...the wonderful line "declined to comment" was used here...
    and was used as well following the "settlement" of bishops/clergymen who suck little boys peni$es....
    and the settlement was paid for courtesy of? ? ?....yes, you got it....the followers....

    if i was the parent, i'd pull a Sandy Hook on that hospital...

    We have to hold our horses and follow investigations . It does not indicate at all that the hospital or healthcare was OPERATED and SOLELY OWNED by the DIOCESE , it could be a privately owned by individuals who also wants to get away with lawsuits. And there , a loophole was sighted and ang state gi luto sa kaugalingon mantika . Does that make the RCC like that if the case is mao gyud na ang nahitabo ? Definitley not but you already said something about being a HYPOCRITE .

    Problema man gud sa kadaghanan and the following I have seen here in the forums lately , anything under the sun that caters issues that directly or indirectly involves the RCC , pwerting lagsika ninyo but then , wala man sense because partial man and halfbaked ang sentiments .     I can only imagine the pain the widower had to go through because of his loss. I wonder unsay lapses/negligent acts nabuhat sa hospital that led to the "wrongful deaths"?

    Legally speaking, I would have to agree with the defense lawyer's argument. We have a somewhat similar law regarding the recognition of the juridical personality of a fetus

    I'm sure the widower can be awarded his claim if his lawyer can prove negligence or any malpractice by the hospital and or doctors which led to the "wrongful deaths" of his loved ones. My prayers are with this guy and his lost family members.

    Ang target man gud diri is to put the spotlight sa RCC and its contradicting teachings and practices kuno . The suits and the likes are just " pakapin " and flavoring na lang para palamian ang sensitive na issue . It is not fair that we arrive to the conclusion without even knowing the core . Ug ang ni kiha nangamong lang diay for monetary gains ? Dili ba lain pod paminawn kung himuon ni siyang defense sa simbahan kuno ? But then , there lies a realistic scenario there. Gi sulti unta unsay malpractie gibuhat , that way , matimbang sa tanan angles and know the story on both sides of the coin.
