    Default company not following the philippine labor code.


    gud day mga accountant, law or uban pa dha..
    need ur opinion guyz.

    I am currently working with a japanese company nga bag-0 pa nagstart. and there policy regarding overtime pay is 100%.

    According to: Official Website of the Department of Labor and Employment Article 87:

    Overtime work. Work may be performed beyond eight ( hours a day provided that the employee is paid for the overtime work, an additional compensation equivalent to his regular wage plus at least twenty-five percent (25%) thereof. Work performed beyond eight hours on a holiday or rest day shall be paid an additional compensation equivalent to the rate of the first eight hours on a holiday or rest day plus at least thirty percent (30%) thereof.

    so overtime pay should be 125% or 130%..

    wla jud mo follow among company sa philippine labor code. ok raba ni?

    I just want to clarify what do you mean by the "policy regarding overtime pay is 100%" ?

    Meaning, for work rendered beyond 8 hours, you are only paid at 100% lang?

    yeah.. 100% ra jud.. our boss said that it's a company policy.. he even told me that he can released a new contract for me with specification of my concern and then after that it's my choice if i'm gonna stay or not.

    depnde most likely 10hrs up... naa sad times na muabot ug 35hrs kung naay giapas na deadline....
