Even if you manage to corner the person holding your cellphone, and manage to prove that it's your cellphone(with your receipt and IMEI),
dilemma 1: you still have to prove that he/she is the one who stole your phone because he/she could have bought it from the theif, which she isn't aware that it was stolen(or maybe lie about it).
dilemma 2: if he/she bought it from the thief, then what?
scenario 1: he/she returns your phone and you give him/her the amount he/she paid the theif.
scenario 2: he/she returns your phone and you give him/her less than the amount he/she paid the thief.
scenario 3: he/she returns your phone and he/she gets nothing in return. She suffers the damage instead of you.
If the thief was smart, he would have sold the phone cheap and fast.
