    They know about incompetence


    THE deteriorating relations between the Executive and the Judiciary reached a new low this week, casting a shadow on the prospects that the different branches of government might yet work together to move the nation forward.

    In a keynote speech before the Philippine Judges Association, Chief Justice Renato Corona accused the Palace of seeking to undermine and even destroy the independence of the Judiciary.

    “Never before, not even during the Martial Law years, had the Judiciary been subjected to “so much disrespect and lack of civility,” the chief justice complained.

    He raised the now-familiar complaints against a Palace plan to take control of some P2 billion allocated to the Judiciary for unfilled positions, saying this violated the Court’s constitutionally guaranteed fiscal autonomy.

    He also denounced the recurring threats from Palace allies in the House of Representatives to file impeachment complaints against any justices who do not support the budget plan.

    The Palace quickly shot back, accusing the chief justice of using the budget dispute as a smokescreen to cover the high court’s mistake of recalling its own “final” decision in a high-profile labor case over a technicality.

    “They brought it upon themselves if there are attacks on their credibility,” presidential spokesman Edwin Lacierda said of the Supreme Court justices. “I think he [Corona] is trying to sidestep the issue on the [PAL] case,” he said.

    While we may take heart in the presidential spokesman’s declaration that such exchanges are “part of the democratic space,” we cannot help but feel that such open animosity between two co-equal branches of government bodes ill for any public endeavor that requires their cooperation.

    For example, while President Benigno Aquino III seems obsessed with throwing members of the previous administration in jail, he seems to forget that he needs the help of the Judiciary to do so.

    The President also speaks of the need to reform the system of justice, but seems oblivious of the need to do so from within the Judiciary.

    While it is unfortunate that the Supreme Court felt compelled to recall its “final” Sept. 7 decision against Philippine Airlines over a technicality, public criticism from the Palace seems to achieve no purpose other than to embarrass the members of the Court.

    Of course, one might argue that the Executive branch knows what it is talking about when it talks about incompetence, but that is another tragedy that is arguably bigger than the current bickering that occupies our attention.
