    Default Need Advice on Dividing An Asset*


    So I got a situation here.
    Say Pedro owns a lot and Juan, Pedro's son, wants to build an apartment on it financed by him. so Pedro got the lot, Juan got the money.
    My question is about the technicalities.
    Eventhough Pedro is Juan's father, how would Pedro protect himself when relationship between them turns sour.
    and what can you guys advice in order for them to have a win-win situation?
    and say, napatukod na ang apartment, how would the revenue be divided?
    Okay raba ang 50-50? or is one of them getting the bigger share?

    settle this among yourselves as relatives/family.

    if you go to court, the whole property will end up in the lawyers' hands.

    Problem solved: both father and son will have nothing to divide.

    seriously, put peso value on the land. that way you know how much contribution is made by the father and son (construction cost). you should be able to get a proportional share out of the investment.

    Pedro and Juan should execute a lease contract to protect their respective rights. In other words, magbayad si Juan ngadto kang Pedro sa paggamit sa yuta where the apartment stands. As to the income this apartment generates, of course kang Juan ra na cya.

    there should be an agreement between the two of you. mostly developer will own 70% of the property & profits and the owner gets the remaining 30%.

    kung ako si Pedro, ako paabangan ang lot aron limpyo ako dawat nga income. . .
    kung ako si Juan, abangan ra nako ang lot, then siguro ang term is at least 10-15 years para makabawi pod ko

    however I got a follow-up question.
    Say abangan ni Juan ang lot ni Papa Pedro for a span of time of 10-15 yrs.
    after that, unsa namay mahitabu sa property ni Pedro? ipaguba'? i don't think so.

    I dont get it bro. so you say magbayad si Juan sa pag-gamit sa lot ni Papa Pedro, right? so meaning ang revenue/abang sa apartment/property (say monthly rent) ni Juan kuhaan sa lease sa lot ni Papa Pedro = net revenue. is that what you mean, right?
    ang pangutana is, until when mani siya mahuman?

    ang akong gnahan mahibaw-an is, if there's a chance for Juan to own Papa Pedro's lot in a span of time.

    after the lease term/period, the lot owner will own the building. That is leasing. but the rent for the lot is small amount ra kay lot ra gyud an iyaha.

    if both parties will agree, the lease term can be extended, depende sa sabot.

    yes, you will pay for the use of lot (if you want it black and white) and its called leasing. the term will end depende sa contract
