sorry to be the devil's advocate here, pero considered ba gyud nga defamation tong gibuhat sa seller? kay by her terms (if the item is not bought within a couple of days after reservation then buyer shall be considered a bogus buyer), matawag gyud bitaw ug "bogus buyer" imong cousin.. i don't think it can be considered libel (written defamation) if true ang gipangyawit sa seller..

i'm not saying ha nga your cousin got what she deserved.. it's just that i'm not sure if you can really pursue a case against the seller..

If she posted it on her own website, okay. But don't you think nalapas na siya sa linya when she decided to message my cousin's FB friends about it?

When you look up the word libel in the dictionary, one of the definition states "to misrepresent damagingly". Don't you think my cousin was being misrepresented when seller messaged her FB friends individually? As if grabe na gyud kaayo ka dako nga crime nabuhat sa akong cousin?

    THE ELEMENTS OF LIBEL

    1. Defamatory imputation - that lowers the esteem, honor or respect that a person is regarded
    2. Publicity - must be seen or known by a third person, other than whom the libelous statement is addressed
    3. Identification - the person libeled must be identified
    4. Malice - if there is no good intention or justified motive for the defamatory statement. Reckless disregard for the truth.

Honestly, nag libog gihapon ko ani.

I don't know if my cousin will decided to tell her parents and sue her. As nitwit mentioned, it's quite expensive. However, I still think the topic is worth discussing. To me what the seller did is not unlike bullying. Like those people in youtube or in the forums post nasty comments that insult people JUST BECAUSE THEY CAN. There's definitely some abuse there.

sis if you have the copy or any evidences of what the seller posted agaisnt your cousin do you mind if you post it here maybe that would help us? you have to have as much as proof as you can as INTERNET OR E-LIBEL is not as common as libel? cause you have to go to ntc first and have those fb screenshots authenticated and they will have to weight how long has it been posted in fb pa gyud. basta daghan gyud na mga condisiones oi!post diri lang sis para pod makabalo me ug gi unsa sa seller pag emotional torture ning imong cousin.

Sorry I can't do that. I have images of the seller's wall when she posted my cousin's pictures, personal information, and account of the transaction. It wasn't so much the words the seller said but the action she took (posting different pictures of my cousin on her business page, messaging my cousin's FB friends, and posting her private information). I don't know exactly how she messaged my cousin's friends, but I did tell my cousin to ask some of her friends to send her images of the sellers private messages to them.

If my cousin decides to tell her parents and they decide to pursue the matter, I can't stop them. My cousin seems to be doing well. But any traumatic experience can have a long-term effect. Ask any child who has been bullied or hurt as a kid.

As for myself, it is my wish that people will think twice next time before posting anything online, particularly if it involves another person. Not for fear of being sued, but out of common sense. For example, if you don't insult people in front of their faces in the real world, you don't do that online either. Otherwise it'll cause huge problems. I don't know if you guys have read the teenage kid who committed suicide because a neighbor decided to do online what she couldn't do in real life thinking it was safe.

Anyway, thank you guys for your input. I think the topic should be changed to: Is it really necessary to post pictures and information of bogus buyers online? How far will you go for bogus buyers? Mag huna-huna sa ko.

Btw, here's another thread involving some kid posting private information of other people on facebook - the police.

Just because you can, doesn't mean you should.

For me, OA ra kaayo nang magpost ug mga "bogus" seller. If you change your mind about buying a certain item in a department store, do the salesladies take your picture and post it in the mall entrance?

Just tell your cousin to move on. C'est la vie.
