    Default Road right of way


    Daghan na ka-ayo ni nga kaso sa Cebu ug Mandaue nga ang balay sirad-an ug agi-anan sa mga dalo nga landowners. Dili ma agi-an ug bombero, ambulansya ug dili gani ka agi ang motorsiklo. Unsa may gihimo sa atong gobyerno ani?

    dili jud na pwede sirad.an oi easements of right of way is a demandable right. however, the true test is sufficiency basta duna lay ma.agian ang nagpuyo sa property nga gipalibutan padung sa public highway. Dili niya mapugos ang owner sa laing property nga muhatag ug right of way if duna siya alternative route sa law pa na nga term egress og ingress...

    Dapat jud na maghatag sila ug right of way. Kung mo insist sila not to give right of way, ipasara ang public nga kalsada padung sa iya yuta. Pagamita nalang na siya og helicopter padung sa iya yuta. Mao gani ang land title nakabutang is "more or less". Kay you have to give right of way sa lumulupyo sa likod sa imong property.

    For us to have a clear picture of your problem enlighten us further... pangutana: duna ba mo lain nga ka agi-an gawas sa property nga imong gi-ingon nga nangayo ug bayad ninyo? ug duna hain man ang labing duol nga mka abot mo sa public highway? and then lain ba sab ang tag-iya?

    why i asked this questions because a road right of way as i've said is a demandable right especially if the dominant estate (meaning ani kanang property nga in its favor the right of way is given) don't have any other way to reach the public highway... ang servient estate kanang yuta nga maghatag ug right of way under the law cannot deny this one to the passing public especially is such right of way has been in existence since time immemorial. meaning kung ang mga tao nag sige na ug agi ana nga property not by mere tolerance of the servient owner but because the servient owner had CONSENTED to it, this can be acquired through prescription so dili na ni pwede e-close sa tag-iya much more mangayo siya ug rent that is extortion...

    Maayo nimo nga buhaton. U have to know the history of the right of way..because the servient of owner cannot deny the use of part of his property as road for the passing public.. dili mani thankyou-hon ba bayaran ni siya after proper court hearing...

    Thanks ka-ayo. Wla na gyod mi agi-anan la-in kay all sides gi pang koral na. Mga dalo man. Part of the servient lot actually was sold to our neighbors and the owner purposely made a road on the same lot for the buyers to pass thru(ari na lang sab mi agi). Only that the owner still consider the lot as private and ask us to pay 250 pesos per family with cars. We have been paying for about a year now and there are 8 families with vehicles affected by this problem. But what concern us most is kon sirad-an ni wala gyoy agi-anan ang bombero.

    ka hangol sad sa tag-iya sa yuta gud. imagine maka-kuarta siya ug mga 2K every month para lang maka-agi ang mga nagpuyo sa likod. di na sad siguro ni sakto uy.
