CEBU City Mayor Michael Rama will temporarily shelve the filing of cases against Police Regional Office (PRO) 7 Director Marcelo Garbo Jr.
The mayor recently wrote Garbo and asked him to explain the series of police deployment at the Cebu Provincial Capitol.
In a three-page letter dated Feb. 8, Rama cited eight incidences at the height of the Capitol standoff where Garbo’s deployment of police personnel were said to be questionable.
The first incident is Garbo’s deployment of 65 personnel at the grounds of Capitol on Dec. 19 when the Department of Interior and Local Government implemented the suspension order of Gov. Gwendolyn Garcia for grave abuse of authority.
He also questioned Garbo’s order to put a team of policemen with shields on standby “to forcibly take out” Garcia from her office.
On Dec. 23, Garbo deployed 200 policemen from different offices in the region at the Capitol to secure the peace and order in the area, Rama said.
Rama questioned Garbo’s instruction to his men to implement Acting Gov. Agnes Magpale’s order to dismantle the tents placed at Capitol on Dec. 29.
On Dec. 30, Garbo made an “irresponsible” statement about forcing Garcia out of the Capitol building and setting up a time frame for the matter to be implemented, Rama said.
Last month, Garbo made Capitol look like a garrison, creating an impression that the city is under siege, Rama said.
On Jan. 5, Garbo deployed 20 members of the Special Weapons and Tactics Division of Mandaue City and Lapu-Lapu City at Capitol.
Last Jan. 31, Garbo ordered RPSB to secure Capitol and the persons who padlocked the office of Garcia.
Last Feb 1, Garbo ordered a battalion to stay at the Capitol to assist the blue guards in maintaining the peace and order in the area.
“It is incumbent upon you as an officer and a gentleman to shed light on this questionable deployment and employment of police officers from PRO 7 rather than that of the Cebu City Police Office,” the mayor said.
In his letter, Rama pointed out to Garbo Section 64 of the Republic Act (RA) 8551 or the Philippine National Police Reform and Reorganization Act provides that the mayor has the authority to exercise operational supervision and control over the police.
Rama also cited Section 28 of RA 7160, or the Local Government Code, which says local chief executives have the authority over the police units in their jurisdiction.
