Can I file against the HR and the Company itself?

I applied last week on one of the logistics company here in Cebu City. I won't mention the name though, maybe one of the employees are member here. I got hired by their Supervisor (he conducted my interview) and told me to wait for a few minutes because they will be giving me the requirements for me to compile in order for me to start working next week because I passed the interview. Now, that I'm done processing my requirements and I am fret for something. When I texted the HR, she told me that she will call me back because she'll ask for my work schedule to their Supervisor. I have been waiting all day after she called me but I got no call or text messages from her. The next day, I texted her and she replied but she has a lot of excuses to me and I'm starting to wonder if there is really a vacancy as per to the position that I applied for.

Now here's my question..

Is it possible for me to sue them? I've borrowed all the money I spent for the processing of my requirements and in the end I have no job and I need to pay soon. Why can't they just tell me what's the problem and just hide?

Note: This is my first job ever so i don't know how this things work.

if you have all the proof that you were really hired na like contract etc maybe you can file a case

I haven't signed a contract yet and all I have was the hand-written requirements and text messages from the HR.

highly doubtful ko if you have a case.. but if you look for another job maybe some or most of the requirements can be used... so "charge it to experience ".. probably all of it its true she is saying probably there is no coordination yet on whether when you can start so probably she cant answer you.. so you just got to have to wait , and apply for another one while at that

Your complaint is non-actionable. None of your rights have been violated. Until you sign a contract, there is nothing binding between you and the company. If the mere breach of an oral agreement is actionable, then daghan na gyud siguro na-priso karon. (NOTE: This is insofar as LABOR is concerned; an oral agreement may be actionable but not in this setting.)

Just because they asked you to submit requirements does not mean that you already got the job. The very reason why companies ask for requirements (which usually include references, past work experience, scholastic records among others) is to see if you are indeed qualified for the job. 'Passing' an interview isn't really indicative of anything except maybe that they like you. 'Like' does not necessarily mean 'Hire'.

(Also, since you were saying you don't have a lot of cash on you these days, I don't think filing a case would be very practical on your part. You will be spending a lot more than you would've been earning from that company, not to mention that it will take up a lot of your time. You're better off spending that precious time and money looking for another job opening. )

@dirk14: but they told me last week that they are really in need of people to work for them as they have a new shifts (graveyard). I even got high scores on all of the exams that I took last week.


@MrKrabbs: I told her (HR) that I will go the office directly but she resisted it but instead told me to wait for her text.


@Jumperman: I understand, I was just really asking if it is really possible since this is really my first time to apply for a job and got hired. No earth on it.

i don't think so.. you can't sue them on the basis nga you're "wondering" if there really is a vacancy..
