    I HAD wanted to write about something important today, which is the 25th anniversary of John Lennon’s death, but I got waylaid into this by the news about Virgilio Garcillano that I saw on TV Monday night. (Fans of the Beatles might wish to add that to Garcillano’s already humongous crimes.) Specifically, I saw Miriam Santiago regaling the world with her breathtaking concept of law and justice. Can you imagine if she had risen to the highest position of the Supreme Court? Raul Gonzalez as justice secretary, Norberto Gonzales as national security chief, and Miriam Santiago as chief justice? And probably Garci turned into chief of the Commission on Elections (Comelec) at the end of the day? A veritable Orwellian nightmare characterized by Newspeak, where titles are the opposite of what they say.

    Santiago was positively gloating. The opposition should be having sleepless nights, she said, with Garci threatening to name names. Apparently, they too had been calling the fellow throughout* the campaign to ask for favors. Even as she spoke, Santiago said, corruption charges against the culprits were being readied. Calling up Garci is corruption, she said.

    What about Gloria Macapagal-Arroyo? Shouldn’t she be having sleepless nights too? Not at all, said Santiago, she should be deep in sleep’s embrace. That was so, Santiago said, because Arroyo enjoyed presidential immunity from suit and -- an attempt at humor! -- because she now enjoyed the intimate company of a husband back from exile. What an un-aesthetic thought. Well, if I recall right, Santiago once displayed her legs as an example of God’s generosity.

    This isn’t just mental masturbation, this is stopping thought altogether. Look where all this brings us:

    One, we may prosecute senators and congressmen for calling up a Comelec official at an indeterminable time and place to help them with their electoral bid but not so a presumptive president who did so at a determinable time and place with the express intention to cheat. At the very least doesn’t presidential immunity pertain only to presidents? The question precisely is whether Arroyo is so or not. Her calling up Garci says she’s not. At the very most, who says presidential immunity exempts presidents from murder? Cheating at the polls murders a nation, which is worse than murdering an individual.

    You can’t charge a crooked president with crookedness so long as she’s president? Then let’s stop making her president and make her stand at the dock.

    Two, we may take the word of Garci against anyone he capriciously chooses to implicate in cheating but not so a tape that clearly, objectively, and ineluctably shows Arroyo called him up to cheat. At the very least if it’s true, as Garci alleges, that a horde of candidates called him up to ask him to cheat, what does that say about his character? The other Comelec officials didn’t get those calls, only he did. That alone must show the kind of reputation he enjoys, which is that of an utter blackguard who sells votes where others sell only pirated DVDs. The fact that others called him up too doesn’t exculpate Arroyo, it only damns him all the more. It makes him out to be a liar and a cheat, whose word is about as trustworthy as the one who said she would not run again but did.

    Not quite incidentally, Garci has already indicted the quality of his forthcoming testimony by declaring that the five-month manhunt for him was superfluous, as he never left the country. Someone asked me completely unbelievingly why he should lie even about that. I proposed to him that maybe, as with a scorpion, that’s just Garci’s nature. He can’t help it.

    At the very most, we have at the other side concrete evidence Arroyo cheated. The veracity of the “Hello Garci” tape remains undisputed to this day, Mike Defensor’s defense having been refuted by the very expert he cited. True, that evidence cannot be used in court because it was illegally obtained, but that only means Arroyo can’t be jailed on that basis, it doesn’t mean she can’t be ousted on that basis. We have a wiretapped conversation where a terrorist proposes to another to bomb a schoolhouse, we are not going to say, “Sorry, but we can’t act on it, the wiretap is illegal.” We stop the bombing, even if we can’t jail the terrorists solely on that basis. Same here: We stop the usurpation, even we can’t jail Arroyo solely on that basis.

    And three, Garci may be free to regale the world with tales of pirates and cutthroats, but Gen. Francisco Gudani and Col. Alexander Balutan may not be allowed to speak their truth. Who is Garcillano? He is someone who, by his own avowal, cut his teeth (into its shark-like formation) with Leonardo Perez, Marcos’ chief counter of votes and plebiscite results. Who are Gudani and Balutan? They are military officers who have forged a reputation of being honest men in a dishonest world. Balutan in particular lives with six children in a modest apartment, while Garcillano lives with who knows whom in who knows where surrounded by high walls and bodyguards. Where are they now? Garci is in Manila, where he enjoys pelf and privilege as the official tirador, while Gudani and Balutan are under arrest and awaiting court martial for saying their piece.

    Santiago, a self-proclaimed constitutional expert, calls that law and due process. Imagine a basketball game where one player is exempt from foul, where a replay about his "pambabalya" [body contact] can’t be seen because it is inadmissible, where the crowd that witnessed his atrocities is forbidden to speak, and you get an idea of where we are. And that is called fair play. No wonder we won the Southeast Asian Games. But that’s another story.

    Hello, Juan de la Cruz, will we still get 85 million sane citizens in the end?
