Probably guilty, says prosecutor
MANDAUE City Prosecutor Ferdinand Peque approved the filing of a murder charge against Jon-nelle Enfec-tana for the death of her close friend, call center supervisor Lynn Vi Ebarita.
Assistant Prosecutor Bienvenido Mabanto recommended no bail. Enfectana is now detained at the Mandaue City Jail.
The resolution to charge Enfectana in court was approved 11 days after Ebarita’s body was found behind a hotel room. She had been stabbed 24 times. Enfectana, the victim’s friend and co-worker at TeleTech, initially cooperated with investigators but was later tagged as a suspect.
Mabanto said the evidence against her so far is circumstantial, but “this web of circumstantial evidence, if taken all together, would result in an undeniable conclusion that (Enfectana) is probably guilty of murder in conspiracy with other persons whose real identities are still be to ascertained as of this date.”
Inquiry
The prosecutor’s resolution said that on Jan. 21, a day before Ebarita’s body was found, Enfectana went to the hotel and asked about Ebarita “who was reportedly missing for several days already.”
She left with the hotel’s staff her phone numbers and requested them to relay information about Ebarita’s whereabouts.
Mabanto’s resolution also stated that witnesses saw the victim, Enfectana and the latter’s cousin together that night.
Ebarita arrived at her family’s stall in Fuente Osmeña around 5 p.m. on the day of the Sinulog parade, where Enfectana and a woman she introduced as her cousin Evelyn arrived an hour and 30 minutes later.
“While Evelyn was at the retail booth, she was observed not to say a word except when speaking to Enfectana in Waray-Waray,” the resolution said.
Enfectana’s cousin, whose identity remains uncertain, was later recognized by hotel personnel as the person who pre-paid P3,000 for two nights in Room 309 of the Nikkei Garden Hotel. It was behind that room where the body was found.
“Evelyn’
Mabanto’s resolution described Enfectana’s cousin, whom she introduced as Evelyn, as wearing “a fisherman’s hat and dark glasses, the same description given by the victim’s sister and TeleTech employees.”
This matched the hotel personnel’s description of the woman who paid for Room 309.
Sun.Star Cebu asked Mabanto if he established the cousin’s identity and address from Enfectana, but the inquest prosecutor said he did not get any substantial information from her.
The Mandaue City Police Office (MCPO) submitted their complaint and the supporting affidavits of witnesses against Enfectana.
She did not submit any counter-affidavit or any evidence, while her lawyer is questioning the absence of warrants during a search in the house where she rents a room and her subsequent arrest.
Laundry
An ABS-CBN report showed Enfectana politely refusing an interview in the Mandaue City Jail yesterday.
On Jan. 28, with the permission of Enfectana’s landlady Felicisima Go, a police team found Ebarita’s wallet, reportedly hidden under a pile of wood and covered with a GI sheet, in the laundry area.
The resolution further stated that after a week’s absence, Enfectana returned to her rented room in the afternoon of Jan. 19 and washed some clothes in the laundry area. (OCP)

I just hope nga hearsay lang gyud ni..kay murag dili mang gyud na maayo..
