This investigation has ZERO credibility. The police continue to rely on the information supplied by a few young kids who allegedly witnessed the "abduction" of the victim. At this point, NONE of the information the police have gathered to date is the result of actual physical evidence. Doesn't that bother anybody? They are relying solely on the "witness" testimony of children, which has already resulted in the arrest and charging of two innocent persons, even though there was substantial evidence that pointed to their complete innocence in this matter. I read today that the police have located and impounded a blue Pajero owned by a British fellow and his Filipina wife. The police also seized a computer from his house (the Brit is apparently out of the country). Oh yeah... The plate on the Brit's Pajero is not even "679", as reported by the witnesses.
In response to the intense pressure to exact justice for the young victim, it seems to be "open season" on caucasians married to Filipinas in Cebu. Are they going to round us all up and see if the kids can make another try at identifying the real culprit? The police have no credible witnesses or leads, and have resorted to an "arrest first and try to fill in the details later" policy. It seems that any caucasian male is now facing the risk of an unwarranted arrest by the authorities, who are desperately trying to regain face after botching this investigation from the start. They tainted the ID of Berger and his fiance with a ridiculous "photo identification" by the wits, and the info they so heavily relied on initially regarding the license number of the suspect vehicle description is being disregarded with the recent seizure of the Brit's Pajero. I have no faith in the judicial system here in Cebu at this point. Guilty until proven innocent appears to be the mindset of the prosecutor's office, and I'm a bit concerned that in seeking justice for the young victim, the rights of foreigners living here are at serious risk of being violated.

The Sunstar article that I read made no mention of a search warrant or court order being used to search the house of the Brit.. The wife may have given her consent to search to the law enforcement agents, as it is highly unlikely that there were sufficient grounds for a search warrant. The article also made reference to a blood stain being found inside the car (again, search warrant?), but no other info was provided on that discovery. The local police should have called for help from the outside at the onset on this investigation. Once an investigation has been so thoroughly botched, it becomes almost impossible to resurrect it to any successful level of adjudication.

@Sand Man: The laws regarding Search and Seizure dictate the circumstances for what is admissible as evidence in court. In some cases, evidence illegally obtained by the police may be deemed inadmissible in court (Google "Fruits of the Poisonous Tree"). In today's Freeman, the article states that the police had a court order to seize and search the vehicle. The police are also now divulging that they also have several ADULT witnesses to what may be the dumping of the young victim's body sometime after the abduction. Where were these witnesses 3 weeks ago?
A sample of what the police suspect to be blood (found in the rear compartment of the vehicle) has been sent to Manila for poss. DNA analysis. We'll see what happens from here...
