BILL OF RIGHTS

Section 2. The right of the people to be secure in their persons, houses, papers, and effects against
unreasonable searches and seizures of whatever nature and for any purpose shall be inviolable, and no search warrant or warrant of arrest shall issue except upon probable cause to be determined personally by the judge after examination under oath or affirmation of the complainant and the witnesses he may produce, and particularly describing the place to be searched and the persons or things to be seized.

You know what there was no unreasonable search nga nahitabo here. The guard used his flashlight to know what is inside the moving car. He did not open it with the use of force, intimidation or whatsoever. What he did was a search in plain view. To make it more concrete take this as example, in checkpoints the driver of the car is not oblige to open the door of his car without his CONSENT but is required to lower down his window and open the back compartment but never to open his door to let the searching officer gets in.
Wala jud sala ang guard ana if nakit-an niya while in the performance of his duty nga nag-*** sila. Maybe the lesson here is to be more extra careful and choosy of the place to do such carnal and sacred act... Peace
