Actually sir the Divine Mercy Sunday is just a regular Sunday the difference is we are putting a significance on that Sunday to celebrate God's divine mercy. There is also a significant event as written by St.Faustina.

^ so, what if a catholic is not in a state of grace, there is no indulgence?

^Actually reg, the indulgences are granted by the pope, and because what the pope decreed here on earth is also decreed on heaven and readily agreed upon by God. But my two cents is, still God has the right to give indulgences to people depending on situation and regardless of his denomination in terms of religion.
