    I'm happy for Gwen Garcia's dedication but she focused too much on culture and tourism, she should provide more time to strengthen our infastructures further, and create more zones for giant business to sprawl.

    IMHO:
    It would be nice is she is placed in the cultural and tourism department, this is where she is good at.

    agree ko ani!

    let's just say that Gwen lobbied for roads then na-realized through national projects, then that means she could have done more like build more and better schools and hospitals (South Gen is private, therefore does not count), improve provincial police stations and their communication and transportation equipments. If this is a PNP matter under the "national", then she should lobby for it. More jobs IN THE PROVINCE.

    Personally, see to it that town mayors involved in gambling and drugs are investigated; I can even name more than my fingers. Though it is something political, she should avoid or have avoided City Mayors that are obviously corrupt because it damages the credibility of the province.

    Lack of funds might hinder holding of hearing in Cebu

    MANILA, Philippines — The Committee on Good Government of the House of Representatives is going to hold a congressional inquiry into the contract entered into by the Cebu City Government and Filinvest land Inc. for 50.6 hectares of the South Road Properties (SRP).

    While the committee has decided to do such, the proposal to bring it to Cebu has hit a snag due to the expenses that would be incurred to bring the committee members and their staff out of Manila.

    The congressional inquiry was called for by Cebu 3rd District Rep. Pablo John Garcia during a privilege speech last April 20 where he branded the deal as “grossly and criminally disadvantageous to Cebu City.”

    Cebuano legislators want the hearing in Cebu, but committee chairman Rep. Pedro Romualdo of Camiguin said that it would be difficult since they will have to spend at least P200,000 for fare alone.

    Romualdo contended that aside from the members of the House of Representatives, the committee will also have to bring their staff to Cebu for such hearing.

    Garcia said that he wants the Cebuanos to hear the proceedings as it is their money that is involved in the deal.

    Rep. Antonio Cuenco of the Cebu City South District said that since the Garcias want the hearing in Cebu, then they should find ways to bring it here.

    Among the allegations to be tackled in the hearing are the “disadvantageous” joint deal, in which Cebu City only gets 10.16 percent.

    Garcia said that it is worth noting that Taguig City gets 69 percent in the same deal it has entered into with R2 Builders for a similar project.

    In Cebu City, Mayor Tomas Osmeña said he would have attended the congressional inquiry had he been invited.

    Osmeña said he is ready to explain to the congressmen that he is not hiding something about the joint venture agreement.

    “I’m willing to explain it over and over again, hour after hour. About the legality, let the lawyers handle that, but about the morality of the joint venture, I can explain,” he said.

    The committee has agreed to get an authenticated copy of the Taguig City-R2 Builders deal to verify this allegation.

    During the committee hearing yesterday, 2nd District Rep Pablo Garcia, Pablo John’s father, reiterated that the sale of 10.6 hectares of the SRP to Filinvest is unconstitutional.

    Speaking before the members of the Committee on Good Government, the elder Garcia cited Section 3 Article 12 of the 1987 Constitution and Section 60 of the Public Land Law which both dictate that although public domain, like a reclaimed foreshore area, can be leased, but “cannot be sold.”

    Garcia explained that the transferee, an individual or a local government for example, “cannot alienate the property without congressional authority.”

    “Taking into account the requirements of conservation, ecology, and development, and subject to the requirements of agrarian reform, the Congress shall determine, by law, the size of lands of the public domain which may be acquired, developed, held, or leased and the conditions therefore,” reads Sec 3 Art 12 of the Constitution.

    In the SRP deal, Garcia said that even if Cebu City can secure the authority, it cannot transfer the ownership of the property to a private corporation, as it would violate the said law.

    “The Constitution bans the sale of public land to private corporations. Therefore, the sale of the 10-hectare lot to Filinvest is null and void,” he said

    But Osmeña argued that if that so, all properties at the North Reclamation Project undertaken during the stint of his father, then mayor Serging Osmeña, were also considered illegal.

    “Unconstitutional… how about the sale of the lots that SM City and White Gold House had bought in the North Reclamation Area, was it also unconstitutional? They only said that the sale of lots at the SRP is unconstitutional because of Mayor Osmeña? Maybe they said no, no that’s not illegal because it’s not of Tommy Osmeña. Simple they want the investors to scare and will not buy the SRP lots,” he said.

    The mayor challenged the Garcias to bring the issue to the court if they believed the joint venture agreement was illegal and disadvantageous to the government.

    “No problem. If they believed that the transaction is illegal, the proper venue is the court. They insult our investors when they said that the joint venture project of R2 Builders and Taguig City is much better than ours,” Osmeña said.

    He believed that the Garcias do not have the intention to bring the issue to the court as they only wanted a “pakulo.”

    “If you listen to the Garcias and (Congressman Antonio) Cuenco and the other congressmen, you are guilty already. That is why I’m ready to attend the congressional inquiry, bahala na even if there’s a trap there. They were doing it for the elections,” Osmeña said. — Liv Campo and Rene Borromeo/NLQ (THE FREEMAN)

    With the article you quoted, Tommy has a point. The law is defined by who is in the position not by the constitution. How about Cebu Business Park?

    If that is the case, then the Garcias ARE ALSO guilty of what Tommy is doing with the SRP.

    Kadtong nag influence peddling ang mga Garcias of selling expropriated titled lots from private entities and muscling their way to the SC to sell the said lots to bigger private entities, unsa man di'ay na?

    Mind you, not all government lots were leased, some were actually sold. Guess who sweetened and brokered the deal...

    At least ang SRP, mostly reclaimed NOT expropriated, so lesser evil. This analogy alone will make you question the motive of the Garcias. To say nga wala sila mag laway sa SRP is pure hypocrisy.

    THE Office of the Ombudsman-Visayas is formally looking into the Capitol’s purchase of the Balili property in Naga, Cebu.

    This follows Cebu City Mayor Tomas Osmeña’s presentation of a geodetic engineer who said only 20 of the 25 hectares of land the Capitol bought for some P100 million is dry land. The rest are underwater.

    “We will ask the mayor to give us a copy of the surveyor’s report,” said Deputy Ombudsman Pelagio Apostol.

    But the anti-graft official will also ask the Capitol for a copy of the report it has commissioned its own geodetic engineers to make.

    “There is already a pending request for assistance. We can consolidate it into a formal investigation once a formal complaint is filed,” he said, in reference to the letter-complaint businessman Cris Saavedra, a known critic of the Capitol, has filed.


    Saavedra, in his letter-complaint dated Aug. 3, asked the anti-graft office to investigate another aspect of the issue, though.

    He alleged that Amparo Balili, the owner’s widow, only got P65 million of the reported P100 million from the Capitol for the property in Barangay Tinaan, Naga

    “Public office is a public trust. Government officials are public servants and it is their duty to protect the interest of the people at all cost,” he said in the letter-complaint addressed to Apostol.

    He recommended an investigation that impleaded the entire Provincial Board, as well as the governor

    Apostol, in an interview with Sun.Star Cebu, also has his eye on a third crucial document—the Provincial Board (PB) resolution that authorized Gov. Gwendolyn Garcia to buy the property.


    Apostol said that if the purchase was intended for the development of a resort, then buying a property that is mostly underwater is not, by and in itself, anomalous.

    The Capitol has indeed identified the lot as the possible site of a resort in previous reports.

    But the PB has authorized the governor to sign an agreement with a Korean power firm to build a dumping site for coal ash on the property.

    “These are all part of what we will look into. We will look into this,” Apostol said.

    Mayor Osmeña, during a press conference last Monday, called on the anti-graft office to look into the purchase and offered to give the agency a copy of Engr. Fortunato Lazaro’s map and survey findings.

    Lazaro, a resident of Barangay Pardo, Cebu City, has also expressed his willingness to testify in any investigation.
