Joavan’s victim disappears; store clerk backs off from robbery case

The 19-year-old sales attendant who complained that Joavan Fernandez shot at him after taking two bottles of Coke without paying has disappeared.

Raymund Paran, whose Dec. 15 ordeal was the basis of robbery charges filed against the Talisay mayor’s son, left his boss a handwritten letter saying he had signed a sheet of paper out of fear for Joavan and accepted P4,000 payment.

The store clerk said he had spent three sleepless nights during which Joavan kept roaming Vista Grande Subdivision in Talisay City looking for him.

Joavan yesterday asked the court to dismiss the robbery charges filed against him.

“We have already peacefully, amicably settled our differences as it was just only a mere communication gap,” he said in a court pleading.

The mayor’s son, who has piled up a string of legal cases over allegations of abuse, presented an affidavit of desistance signed by Paran.

In it, Paran said he was “no longer interested to pursue the criminal complaint” after patching up their “misunderstanding.”

Regional Trial Court Judge Gilbert Moises of Branch 18 has scheduled a hearing on March 16.

Bail was recommended at P10,000 for Joavan but the court hasn’t yet issued an arrest warrant.

Talisay City Prosecutor Marshall Rubia said the affidavit was a “scrap of paper” unless Paran appears in court to verify its authenticity.

If the young man signed under duress, the document can’t be be used as basis to dismiss the case, he said.

Rubia said the criminal case can still proceed based on other evidence since the complainant is just a vital witness.

“We will require Paran to be presented in court to authenticate the affidavit of desistance,” said the prosecutor.

In the complaint, Joavan drove to the cooperative store in Vista Grande Subdivision in Talisay City last Dec. 15, ordered two bottles of Coke Litro, then left without paying for them.

Joavan allegedly pointed a gun at the attendant saying, “Unsa man ka, pamasaker ka (Do you want to be massacred)?” and then he fired a shot near the store clerk who was so scared he let the mayor’s son drive off without paying.

Last March 5, Erlinda Anderson, president of Vista Grande Homeowners Association, went to the police station to report the attendant’s disappearance.

She showed his letter wherein Paran apologized to her for the trouble and explained that he signed a piece of paper for Joavan, accepted P4,000 given to him and took P1,100 from the clubhouse to use for his father’s medical treatment.

A co-worker told the police he saw Paran last March 4 about 10 p.m. riding a red vehicle owned by Joavan.

In a radio interview, Anderson said the store attendant had confided in her that Joavan threatened him to file countercharges against him once they lose the case.

She said Joavan has been banned from entering the private subdivision since the Dec. 15 incident but somehow still managed to get inside, possibly because the security guards are afraid of him.
