naa daw article sa atong constitution chuva na pwede daw dakpon na ang manglabay ug animals sa dalan? or abandon them anywhere... if knsa tong mejo may alamag sa mga ingon ana, pwede mo muverify? kay il make it my life's mission to imprison those sick people leaving their pets on the streets! di sila maluoy.. unya usually bya kay mga puppies/kittens pa.. baby pa bya na pro makaako sila. di ko kasabot ngano naay taw nga ingon ana. mura mn gani kog mamatay mamatyan kog pet unya sila noh, sayun2xon ra jd. grrr! ug kana pud diay mga mu-hit-and-run ug mga animals kay pwede daw pud na dakpon. well, actually multa xa and if dili ka kabayad sa multa, priso ka for 6 months... so i wanna know if this law exists. kay i want to exercise it!

there is NO such thing in the constitution. from PREAMBLE to ARTICLE XVIII of the 1987 constitution.

hit and run on pets, thats possible to file a case of "destruction of property" and pray for damages. since in my opinion; property in the eyes of the law is anything which you own, has value, can transfer ownership, can be legally owned, legally stolen thus can be construed as chattel property. though i havent read any SCRA(supreme court report annotated) or jurisprudence in the light of this matter. though based on autralian law and other countries their law see pets/animals as chattel or movable property.

the closest law regarding this subject matter in philippine setting is:

REPUBLIC ACT NO. 8485

AN ACT TO PROMOTE ANIMAL WELFARE IN THE PHILIPPINES, OTHERWISE KNOWN AS "THE ANIMAL WELFARE ACT OF 1998".

thus to qoute:

Sec. 6. It shall be unlawful for any person to torture any animal, to neglect to provide adequate care, sustenance or shelter, or maltreat any animal or to subject any dog or horse to dogfights or horsefights, kill or cause or procure to be tortured or deprived of adequate care, sustenance or shelter, or maltreat or use the same in research or experiments not expressly authorized by the Committee on Animal Welfare.

penalty clause of this republic act is prision correctional on its minimum period(6 months and 1 day to 2 years):

Sec. 8. Any person who violates any of the provisions of this Act shall, upon conviction by final judgment, be punished by imprisonment of not less than six (6) months nor more than two (2) years or a fine of not less than One thousand pesos (P1,000.00) nor more than Five thousand pesos (P5,000.00) or both at the discretion of the Court. If the violation is committed by a juridical person, the officer responsible therefor shall serve the imprisonment when imposed. If the violation is committed by an alien, he or she shall be immediately deported after service of sentence without any further proceedings.

hi guys. sorry ha for the delay. the doogies are doin great. but actually nag duha2x akong uyab kay murag na attached na siya.. he wants to adopt 3 of em! lols I will have to confirm it sah if iyang dayunon ug adopt. murag na anad na siya naa silang 3 pirmi. ;p plus, they're really sweet and good doogies so its not hard to like em. hehe ;p
