    comment lang though at first i thought it should be the parents/guardian's fault but further reading here changed my mind.

    d ko ka imagine unsa ka shocking ang na felt sa inahan ani, laliman bya kag g gukod nya ang iya anak dn all of a sudden kalit natagak kay nabuak ang glass railings, in front of her own eyes jd na ha..grabe jd cgro iyang pgka shock ato dn wa pa jd ka kahibaw kng naunsa na iya anak sa katong nahagbong na..wat f sa 3rd floor to nahitabo simbako lng..

    mao don't blame the mother of the child kay wa mo kahibaw unsa iya na feel o trauma while seeing her child fall-off the railings..

    cgro ang physical damage sa bata mabayran ra, pro ang emotional damage ug trauma sa parents labi na sa bata d jud na kabayran ug kwarta..

    Yes, responsibility sa parents to look over their children.

    However, responsibility sa SM Property Administrator ang condition sa mall premises. Preventive measures should have been undertaken like crowd control kung naai maglean sa glass railings AND it is our social responsibilty pud to observe proper decorum if naai mga artista sa event hall nila dili magsigeg duot. Imagine the damage if this happened DURING an event.

    So, i would say, technically, responsible ang SM under "premises liability".
    They have provided financial aid naman daw. Let both parties arrive to a proper settlement.

    naa jud me sa SM ato nga time sa pang hitabo....luoy kaayo ang bata dugo2x dugay pa jud kaayo na abot ang mga medics....grabe ang commotion between guards og mga osisero nga mo take og video/photo instead medic unahon clean the areab nuon ila gi una..

    hope ok nato ang bata...medyo luoy jud kay mura man to og ni suka og blood ang bata not sure...

    As a parent/guardian, it is your RESPONSIBILITY to ALWAYS look after your child. It would be irrational to stop your child from running around the mall (kay ngano sa park ra pwede magdagan2?) BUT then again, it goes back to what is your RESPONSIBILITY while in a private/public place. As I said in my previous posts, ang mga glass railings wala na gibutang para dam-agan or sumbagon. It serves as protection para walay mahulog while walking or leaning down, for this case, to the entertainment center. In addition, maong glass ang gi install para clear kung mo lean sa ubos or kung motan-aw ka sa babaw. Then basin nakalimot mo nga glass na, naa na wear and tear. If moingon mo why wala nabuak kung daghan tawo labina kung naay artista. Mo ask ko naa diay mag pakong2 sa ulo or magpatid2 sa glass ana nga time? Ug unsay gusto ninyo ilisan na ug fiber glass tanan? Very impractical.

    In my case, I will put blame to both parties, myself and SM. Kay as a parent/guardian, I know unsay akong responsibility and at the same time kahebaw ko unsay tinuod nahitabo. Kung ato lang tan-awon unsay root cause then maka conclude ko where i point ang finger. But I would not rather to that since none from both parties deserves harsh comments yet I will be thankful to the management for the financial help. And the fact is, neither from the parties put their blame unya kamo na nuon nga nagbasa ra diri dili mismo ang hintungdan. By this incident, I should learn a lesson and be extra careful and vigilant for my kid(s). Likewise, SM should also take necessary action to prevent this from happening again. I did checked the area few hours ago, naa nay guard nga nag roving, nagbantay ug namadlong sa mga tawo.

    tan-aw nako,bug-at ang sala sa SM ani, kay wala na ma monitor ang mga wear and tear sa mga rail or unsa pa diha, depekto nagyud to ang bildo, kay ako mag tukod sad ko sa rail usahay kay tanaw sa ubos kung unsay lingaw... bisan unsaon nako tukod gahi man gyud kau ang bido, not unless kung tuyo-on og sikad at full strenght kana bo-ak gyud, pero og bata lang... grabeh napud na oi kus-gana bata-a gud, mag butang sila sunod og "CAUTION DON'T LEAN ON THE GLASS RAIL PLEASE"...

    I overheard from a person in SM this afternoon that the glass had a chink (or crack). When the boy ran towards it, the glass broke off.

    Kun sa States pa ni na hitabo, pwede kaau maka.file ang parents of the child for injury claim against SM.

    now that it happened, cautious na lang jd ta as a parent/guardian. pang-puno sa already stressful mind we are undergoing everyday.

    maypa i-edit ni ni TS ug butangan ug poll question para makita natu kinsa jd ang i-vote sa mga istoryans - parent or SM?

    kay aku, SM jd ko - 100% at fault ani.

    why? the answer is found in the name of the purpose of this glass, and that it is a - GLASS BARRIER.

    Barrier gud nah so dapat ni-serve na siya sa iyang purpose, so kay wala man, meaning at fault ang tag-iya ana nga barrier.
