wab.. the law may be hard.. or sometimes 'perverted' but that's the law..

however, the law also is specific.. and have set forth circustances that would apply to this rule as an extention of the home: and apparently, the prosecuture have examined the underlying circumstances ( that people do not assemble at a parking area since only those with vehicles go there for the sole purpose of leaving their vehicles temporarily; and that the alleged sexual act was done inside the couple’s tinted vehicle and could not be easily seen from the outside ) to be of absolute belief that the couple has a premeditated intention of doing it, having a mindset that chances of getting caught in the act while doing it in a "basement parking are" has remote possibilities.. which i think warrants the charges to be insuffecient as to convict them for grave scandal..

i guess the problem here is there is a great disparity between creterias set forth for it to be considered right/proper or otherwise in legal parliance and with accustomed moral standards..

She noted that people do not assemble at a parking area since only those with vehicles go there for the sole purpose of leaving their vehicles temporarily.

Also, Rabillas said that the alleged sexual act was done inside the couple’s tinted Ford Lynx and could not be easily seen from the outside.

“The offense against decency cannot be considered to have been made public,” the resolution read.

A prosecutor also noted that the vehicle is an extension of the home, and what goes on inside the vehicle is private.

pero wab, i never said that these people should be imprisoned. i merely proposed that they be reprimanded. like i said, if you don't prohibit such acts, it basically means that you allow other people to do the same thing.

okay, let's say that no one was around when it happened. but what if someone passes by and notices the vehicle shaking in an odd way. do you want people to just ignore it and say: "hey, they're having *** inside the car. let's leave them alone."

now what if all the rest of the couples with tinted vehicles in the same parking lot feel the urge to do the deed then and there, would passers by say the same thing? i don't know about you but that would be most certainly unpleasant to see. you're like consenting to the idea of turning every dark corner of this city, provided that you own a heavily tinted vehicle, as long as no traffic rules are violated, no person is in "assembly" into a motel.

that's why they say: "hey! get a room!"

the guard has a reasonable ground to peep inside the car kay lage nag uyog2x! and u cant deny that your car is subject to scrutiny for security matters and the fact also that said car was in the vicinity of the AYALA parking lot! hence, such guard could never be sued for intrusion of privacy. and guys are you familiar with PLAIN VIEW DOCTRINE?? --- this is the case wherein no search warrant needed as long as it is in plain view that something felonious is done!! now to stop this crap; the charge should be dismissed- why? they are not doing such thing in public because the car was said to be tainted and for the public to see it is to peep over it... and the guard although vested with responsibility and authority to check for whatever security purposes after knowing that it's only a couple having *** in the car and nothing to do with stealing, carnapping, bombing and so forth... HE MUST HAVE LEAVE THEM ALONE! and one thing... the proper charge against the guard should not be intrusion of privacy but UNJUST VEXATION which is punishable by arresto menor or a fine ranging from 5 pesos to 200 pesos or both (Art. 287 of Revised Penal Code). Thanks! and Have A nice day! :mrgreen
