okay.. so dili lang revocation sa license suspension for 90 days.. moral damages 250 thousand.. attoryney's fee 50 thousand.. exemplary damages of 200 thousand.. cost against the respondent.

wapak! dako d.i sah?
Agree man ko nga naa gyud sayop ang mga medical practitioners ni attend ni JanJan but their ethical lapses are not that grave as what the media is sensationalizing it to be and if I were those doctors, I will also try to blame the system in the government hospitals thus it will boomerang to the government.
Mo ingon sad ko kung naa to private hospital di man to ma ingon ato because proper procedures and protocols are IMPOSED and FOLLOWED there.
Without the video, could JanJan have sued? I don't think so! So let us also zero in on who really took the footage kay kanang ka unprofessional ug ka samok sa government hospitals given na man na, whether we like it or not.
Di sad unta nila kalimtan ang nag paslak, kay sa tan-aw nako sa mga doctor ra man ga sige ug concentrate ang tanan. Unsaon ta man wa man gud to'y nahut ang callboy di sad to madug-an ug kwarta.
LASTLY, I am not trying to put the thread starter in a hot seat because he or she might have just copied and pasted it but WA MO MAKABANTAY? The title of this thread ends with the word SPECTACLE, not SCANDAL or CONTROVERSY. In a spectacle, people are AMAZED or LAUGHING, way manghilak, kaguol or kaluoy. So this only affirms that though the doctors were unprofessional and/or probably homophobic and prejudice, they were only human and their offense was not that grave. The only thing that made this controversial is the video, so they should catch who took the video and the people responsible in securing the OR ana ra na ka simple.
I know we have varying opinions regarding Jan2x's case. clash of opinion's like these are healthy coz it provides u to debate on the arguments.Originally Posted by LytSlpr
anyways, yes, i have been to VSMMC, CCMC, and even Community Hospital. yes, they have lax control and systems as compared to private-run hospitals.
as u said, maoy naandan...well, too bad.
AND THE BIG "BUT", is that hospitals don't make the doctor or nurses. bsan pa ibutang ang medical "professionals" sa farthest flungs of Timbuktu, or even in the midst of a war zone, they have sworn to uphold their duties to save lives & at the same time uphold their code of ethics that is given to them as "privilege" to practice medicine. SAVING LIVES and ETHICS must always go hand in hand and not w/o the latter.
i even have a cousin doctor who also witnessed part of the operation. thankfully, she was on her right mind ug wala ngpada sa hitabo. otherwise, apil unta toh cya sa kaso...she even cautioned some peeps about it, and told them not to let too many peeps inside the OR. but unsay nahitabo? walay naminaw niya...see?
ok, ok, so we myt say also that mao na gyuy "culture" sa gov't-run hospitals. well, what better way to wake them (entire Phil medical industry) up than this video scandal...and wow, in Cebu pa gyud!
if I were one of the doctors there in the OR and deny it, it would just makes matters worse for me. why? ngano mamakak pa man ka nga nakita man sa youtube...even if we say wala makita imong nawong, naa may hospital records to prove u were there performing the operation...Originally Posted by LytSlpr
u r correct, hospital admin will take the blame for the lax procedures but those indicted were part of the hospital admin as "staff" as well...
again, being homophobic has NO RELATION to the case...abi ky mahadlok ug bayot ang usa ka judge or fiscal, dili na nuon mo-pabor sa bayot? di ko kasabot sa imong buot ipa ibot...u mean they will become biased and SUBJECTIVE on the victim's sexual preference & character, and not on the SUBSTANCE of the case instead? aw c'mon...Originally Posted by LytSlpr

now let's get back to "PROMINENT FAMILY" and being "influential". do u think these doctors even have the hint of likeness of a Dr. Larrazabal? do u think Dr. Arias and Dr. Montecillo have enough clout (politically or financially) to turn the case around in their favor? pgka layoa ra gyud sa nangahitabo karon...
what logic is "Jan2x like a prosti crying rape"? as ive said before, Jan2x could not even come close to being a prosti no matter how u make out of him in various analogies. he is the "customer"...just like a man paying for ***, just like a lesbian paying for ***, just like a female paying for ***...and cried rape.Originally Posted by LytSlpr
na pasa2x ang kaso between DOH and Ombud doesn't mean they are not concerned over the case. it was just to avoid overlapping of jurisdiction. In this case, "concerned" is related to their duties & obligation to prosecute. it may not be called "sympathy" at all but this is what we call "trabaho lng, walang personalan". DOH being corrupt is even out of the question. ky ngano mangikik cla aning kasoha?Originally Posted by LytSlpr
yes, what we are just doing here are just speculations on whether who sides with who. But my point is, it is more logical to say that more are siding with the victim...not the other way around.
there are only 2 possible realistic scenarios that could have happened:Originally Posted by LytSlpr
(1) Jan2x inserted the canister by himself to:
(a) self satisfaction in a perverse way (thinking makuha ra by himself), (b) accident (no intention of inserting the whole canister)
(2) the callboy inserted the canister into Jan2x anus to:
(a) get back on Jan2x for insulting him, (b) other motives (i.e. make fun of Jan2x)
both have equal chances of happening. who knows but c Jan2x ra gyud...
and what compromising situation r we talking about? nga kataw-anan kau iyang kahimtang pag abot nya sa hospital? IMHO, the doctors and nurses made Jan2x's situation compromising instead...as i've mentioned before, the issue is never the patient.
i didn't say jan-jan's case would "surely" strip the doctor's licenses. what i said was it could be possible, depending on the outcome of the investigations.Originally Posted by LytSlpr

DOES THIS HYPO SCENARIO MAKE A "SUBSTANTIAL" DIFFERENCE w/ Jan2x's case? NO.
simple...blame the doctors & the hospital...somebody has to be blamed u know.Originally Posted by LytSlpr

and to say that we should focus more our attention on the one who posted it on youtube, i beg to differ. we should focus more instead on what we have seen on that video and think about it. IT'S MORE OF AN EYE OPENER TO ALL. i am even tempted to thank the youtube poster for it...

i have asked around, maybe mga 4 na ka bayot and asked," would u really insert a black suede canister into ur anus by urself?" their answer is, "sus Ginoo ko, dili intawn wui!!! nangabang gani ka ky gusto ka ug tinuod..."...

anyway, 1 factor na dapat i-consider sa amount nga gi-demand is the filing fees. dili dawaton imong complaint kung wala'y bayad. of course speculation ra ni on my part, pero i'm sure nga ang filing fees gi-consider na sa pagdecide kung pila ang demanda. although pwede man ma waive ang filing fees, kinanglan mo apply pa ka to file the case as a pauper litigant. ambot kung ni-apply ba ang complainant.
kung sa legal aspect lang, IMO, the "victim" has a cause of action against the doctors, etc. for moral damages. actually sayon raman i-identify ang victim - hospital records: on Xdate, a patient with the name of Y was operated on to remove the canister. all the victim needs to do is show that he is patient Y. obviously, dili man maka deny ang hospital nga diha silay patient with that medical condition.

.. yo minu, thanks for that. we're enjoying our little discussions here about janjan's arse, hehe. We tackled morality then by-laws, i don't know what's next. Anyway, this case has now ceased in the public eye. No reports here with my neighbours too.
