MANILA, Philippines - Former President Gloria Macapagal-Arroyo has asked the Sandiganbayan to suspend proceedings on the plunder case filed against her by the Office of the Ombudsman over the alleged misuse of some P366 million in Philippine Charity Sweepstakes Office (PCSO) funds.

Arroyo wants the anti-graft court to send the complaint back to the Ombudsman, as well as not to issue a warrant of arrest for her, since plunder is a non-bailable offense.

In an urgent motion to suspend proceedings filed by her lawyer, Anacleto Diaz, Arroyo said she only found out about the filing of the case through the media, and that she has not received any resolution from the Ombudsman on the issue.

Arroyo's camp said she will file a motion for reconsideration of the adverse resolution of the Ombudsman.

"It is a well-settled rule that a person under preliminary investigation by the Ombudsman is entitled to file a motion for reconsideration of the adverse resolution. This right is provided for in the very Rules of Procedure of the Office of the Ombudsman," her motion said.

Arroyo added that the Supreme Court has held that the filing of a motion for reconsideration is an integral part of the preliminary investigation proper.

She wants the ant-graft court to compel the Ombudsman to give her a copy of the resolution.

Arroyo's first plunder case is set for hearing on Friday, July 20.

if one is dismissed another case will be filed. it is good only until the end of the term of the current president.
