    Supreme Court overrules Justice Secretary, says its temporary restraining order on the government’s watch list ‘in full force and effect’

    SENATOR Aquilino Pimentel III on Tuesday admitted there was still no evidence linking former President and now Pampanga Rep. Gloria Macapagal-Arroyo to the supposed electoral fraud in the 2004 and 2007 national elections.

    Pimentel, who filed the electoral fraud complaint against Arroyo before a joint panel of the Justice Department and the Commission on Elections, told reporters that two Senate hearings had produced no clear evidence of Arroyo’s involvement in poll cheating.

    Arroyo was arrested Nov. 18 after the Comelec, acting on the joint panel’s recommendations, filed charges against her before a Pasay City court.

    Meanwhile, the Supreme Court on Tuesday ruled that a temporary restraining order that it issued allowing Arroyo to travel abroad on Nov. 15 was “in full force and in effect,” even though she had not yet complied with one of three conditions set by the Court.

    Court spokesman and administrator Jose Midas Marquez said the justices decided to vote on the order’s effect after Justice Secretary Leila de Lima refused to carry it out on the basis that Arroyo had not authorized her lawyer to receive subpoenas on her behalf, one of three conditions set for her travel.

    “The Court resolved that the TRO was not suspended,” Marquez said.

    “The justices voted 9-4. Four were of the belief that the TRO should be suspended. The TRO remains in full force and effect.”

    De Lima’s refusal to carry out the Court’s order prevented Arroyo from traveling abroad for medical treatment. Her action gave the government enough time to file an electoral fraud case against Arroyo before a Pasay court that ordered her arrest.

    Arroyo’s lawyers on Tuesday asked the Supreme Court to dismiss that case, saying it was based on an invalid investigation.

    Benjamin Santos said the preliminary investigation, conducted with “undue and unbelievable haste” by the joint panel, violated Arroyo’s right to due process.

    He said the Comelec had become an “instrument of oppression” because its chairman, Sixto Brillantes, failed to inhibit himself from the case even though he acted as a lawyer for Arroyo’s political rival in the 2004 elections.

    Earlier, Arroyo’s husband, Jose Miguel Arroyo, filed a similar petition that described the government’s case as political persecution.

    At the Senate, Pimentel said the goal of the congressional hearings was not to develop a case against Arroyo but to come up with measures to prevent poll fraud.

    Two new witnesses were presented at Tuesday’s hearing.

    Ahmad Mamucao, who claimed to be a former election consultant of the Ampatuan family of Maguindanao, and Lt. Col. Pedro Sumayo, a military intelligence officer who said there was an attempt to cover up the wiretapped conversation between Arroyo and then elections commissioner Virgilio Garcillano, which became the basis for the “Hello Garci” scandal.

    Mamucao said that in 2007, former Maguindanao provincial administrator Norie Unas gave him P17,000 and instructed him to haul some boxes from Bukidnon that contained blank ballots, election returns and certificates of canvass.

    Sumayo said that several weeks before the 2004 elections, whistle blower Sgt. Vidal Doble Jr. presented him recordings that seemed to contain Arroyo’s voice. He contacted his superior, Col. Allen Capuyan, who told him to destroy the tapes, which he did, he said.

    He said he asked Doble to surrender the tapes and the transcripts of the recordings and burned them as Capuyan ordered. He said he was later relieved after being tagged as part of the core surveillance team that wiretapped conversations between Arroyo and Garcillano.

    When he sought Capuyan’s help in October, Sumayo said, he was given P900,000 by one Col. Emil Zosa, who had said it was assistance from Capuyan.

    He turned over the nine bundles of P100,000 to the Senate panel.

    if there are people who want Gloria dead that would be the anti PNoy group because PNoy is racking up pogi points in this gloria brouhaha.
