But Santiago downplayed the issue of extradition, saying the absence of which would not necessarily prevent the Philippine government from going after a fugitive from justice or a person with a pending case.
“If the applicant is accused of a non-bailable offense and there is no extradition treaty between her state of destination and the Philippines, her mere failure to return might result in a defeat of justice, but it will not be a threat to national security,” she said.
Santiago described an extradition treaty as a contract between nations to turn over a wanted person staying in the other state’s jurisdiction.
“It is not so simple to argue that if the applicant goes to a country that has no extradition treaty with the Philippines, there is no way of getting her back,” she said.
“The matter of extradition can be either contractual or political. This means that even if we have no extradition treaty with another country, if that country wants to extradite the applicant, there is no rule in international law that prohibits a country from extraditing a foreign national as an exercise of state sovereignty.”
“It’s not difficult to get a Filipino, unless, of course, there is an existing conflict between the Philippines and the other country, if the relationship is bad,” she said. “But otherwise, I don’t know what the big fuss is all about.”
yes that is the general idea of an extradition.
mao bitaw naa jud treaty para dli magsalig kay tungod in good terms man ang mga nasod so pwede ra diay ma extradite pero naa xa mga guidelines mao bitaw gihimo ghapon ang treaty... By enacting laws or concluding treaties or agreements, countries determine the conditions under which they may entertain or deny extradition requests. Common bars to extradition include:
Failure to fulfill dual criminality, Political nature of the alleged crime,
Possibility of certain forms of punishment, Jurisdiction over a crime.

however in European union in which the prima facie evidence and a possible fair trial have been waived.

Why? People die everyday, what makes this one catastrophic? Dude are you sure there's that much love for PGMA. I don't like Noynoy's admin, but even I'm scratching my head at this statement. It seems you're implying an EDSA-4 if PGMA dies. Uh... really? Be realistic dude...

I do not like her, it's just that the woman is sick and she needs medical treatment, ASAP.

Well, she still has several supporters though. We do not know what will transpire. I'm not implying that EDSA-4 will happen.

By consequences, I do not mean people will rally against the current President, what I mean is; IT will severely tarnish his reputation, since it is his decision not to let her go.

it means that if GMA dies then she was really sick and Noy will look like a total jackass. It means all their accuses like she will escape are baseless lies and people will loose faith on him over more.

Add this to giving money to rebels, Noy's constant overstepping on the other Branches, the death of GMA would trigger will trigger his ousting. Afterall, who wants a vindictive megalomaniac for a leader?
