Arroyo fights on two fronts

Former President Gloria Arroyo’s husband Jose Miguel Arroyo on Friday fought his legal battles on two fronts, the Supreme Court and the Office of Ombudsman.

At the high tribunal, Mr. Arroyo sought to stop the Department of Justice and Commission on Elections from probing into his alleged role in the 2007 election fraud, saying the joint inquiry was part of efforts to persecute him and his family.

At the Ombudsman, his lawyers moved for the dismissal of the plunder case filed two months ago by Bayan Muna Rep. Teddy Casino against the former first gentleman. Arroyo stressed that the complaint was a rehash of allegations that had been rejected by the Ombudsman in 2009 and 2010.

Arroyo said the complainant had nothing new to offer since the Ombudsman dismissed the case in the Joint Resolution of April 21, 2009 and the Joint Order of April 19, 2010.

In 2008, at least four complaints were filed against him and other respondents on the same accusations which were consolidated and eventually junked by the Ombudsman, according to Arroyo.

The decisions, he said, resulted in the filing of graft cases before the Sandiganbayan against former Comelec chairman Benjamin Abalos Sr. and former NEDA director general Romulo Neri.

He denied that he and his wife, now a Pampanga congressman, received commissions and kickbacks amounting to $30 million from China’s ZTE Corporation in exchange for the approval of the contract for the national broadband network.

Arroyo’s lawyer, Ferdinand Topacio, meanwhile asked the high tribunal to declare as illegal and unconstitutional the joint inquiry into the alleged poll fraud.

He said that the Justice-Comelec panel headed by Secretary Leila De Lima committed grave abuse of discretion since they did not have jurisdiction in issuing the order.

The joint panel, created last August 15, said it found probabale cause to subject the Arroyo couple to preliminary investigation for alleged electoral sabotage.

Topacio accused President Benigno Aquino III and his allies of “acting suspiciously synchronously” to start a massive trial by publicity at the expense of the Arroyo’s couple, without having solid proofs of evidence to pin down the Arroyos.

Topacio also cried foul over a number of public pronouncements against the Arroyo couple made by the President and several of his officials, including of the Palace, the DoJ, and Comelec as if preempting the results of the joint panel investigation.

Topacio called for an independent and impartial tribunal, invoking the former First Gentleman’s right to a fair proceeding.
