Court orders return of vehicle to Santos

THE court yesterday ordered the blue Mitsubishi Pajero returned to Bella Ruby Santos, one of the suspects in the Ellah Joy Pique case.

This, as Regional Trial Court Judge Meinrado Paredes denied the partial motion for reconsideration filed by the lawyers of the Criminal Investigation and Detection Group (CIDG) 7, in an attempt to keep the vehicle.

Paredes, presiding judge of the RTC Branch 13, denied the motion filed by Inocencio dela Cerna and Glenn Condor, CIDG 7 counsels, “for utter lack of factual and legal basis.”

The judge also denied the police’s motion, seeking to inspect the Pajero.

Motions

A few hours after he issued the order releasing the Pajero, Paredes tackled the motion for partial reconsideration that Renante Pique, Ellah Joy’s father, filed, asking the judge to retain six items seized from the house of Santos.

The judge also heard the omnibus motion filed by Santos’s lawyers, opposing the court viewing of the contents of the suspect’s USB flash drive and video camera.

Paredes deferred the anticipated court viewing of the contents of the USB flash drive and video camera. He ordered both parties to present their respective information technology (IT) experts on May 6.

The police have filed kidnapping with homicide charges against Santos and her British boyfriend, Ian Charles Griffiths, in relation to the death of Ellah Joy, 6.

During the hearing, dela Cerna tried to block the release of the Pajero, saying they would exhort available legal remedies to retain the vehicle.

However, Paredes told dela Cerna only a restraining order from the higher court can stop the release of the vehicle to Santos.

In his 11-page order, Judge Paredes said, “there is no dispute that the vehicle seized in the course of the implementation of the search warrant was tampered.”

Paredes said the court issued the search warrant to seize the Pajero bearing the license plate LHJ-382. It turned out, however, after subsequent hearings, that the vehicle’s license plate is LMJ-382.

Allegation

The police believe that the Pajero was allegedly used by the suspects in carrying out the crime.

Joan Saniel-Amit, one of the lawyers of the Children Legal’s Bureau who provides legal aid to Renante, admitted that their client did not intervene when the CIDG 7 applied for search warrant to raid Santos’s house.

Amit said they filed the motion to inform the court that some of the items seized, including pornographic compact disc covers, are contraband under Republic Act (RA) 9775, or the Anti-Child Pornography Law.

Objection

Paredes ordered Amit to submit in two days their reply to the defense’s omnibus motion.

The defense panel also objected to the supposed viewing of the contents of USB flash drive.

Paredes said the court is not interested to view the *** scene inside the video camera.

If there are *** scenes of Santos and Griffiths in the video camera, Paredes said he would stop the viewing as these have nothing to do with the kidnapping with homicide charge against the couple.

Still, Santos’s lawyers Rameses Villagonzalo and Anna Luz Cristal objected to the viewing of the USB’s contents using a laptop of the CIDG 7 IT experts.

IT experts

In the end, both parties agreed to present their own IT experts when the court hearing resumes next week.

Paredes said the court would also present its IT specialist.

During the hearing, Santos stuck out her tongue at Renante. “Gaba! Namatay imo’ng anak (You’ve had your comeuppance. Your daughter is now dead),” she said, laughing.

Renante gestured at Santos, making the face of a devil at her. He was overhead saying he merely wants to justice.

After the hearing, dela Cerna said the return of the Pajero to Santos will not weaken the kidnapping with homicide charge the police filed against the couple at the Office of the Cebu Provincial Prosecutor.

The CIDG 7 lawyer he respects the decision of the court, besides the judge upheld the validity of the search warrant.

Forensic pathologist Dr. Raquel Fortun, who was hired by Santos to evaluate the items seized by the police during a March 4 search at Santos’s house, said she merely documented and photographed the items.

Fortun refused to comment on the condition of the seized items and how they were kept.

What's more interesting on the case is that the judge who handles the case has been found guilty of incompetence and undue delay by the Supreme Court over resolving the motion relative to few civil suits in the past. And the freelance "IT Expert" kuno who is not a certified forensic investigator was hired by the judge to help on the viewing of the USB content, but was also an alleged scammer as posted here.

Bella Ruby Santos arrested

CEBU CITY (Updated 5:45 p.m.) -- A Cebuana who was accused along with her British boyfriend in the killing of a six-year-old girl in Naga, Cebu was arrested in SM Megamall Friday.

Agents of the National Bureau of Investigation (NBI) nabbed Bella Ruby Santos when she was spotted shopping at SM Megamall in Ortigas Center, Pasig City around 4:30 p.m., reports said.

She was brought to the NBI office in Manila.

Santos went into hiding after Regional Trial Court branch 6 Judge Ester Veloso issued last July an arrest warrant against her and her boyfriend Ian Charles Griffiths for the death of Ellah Joy Pique.

Pique's body was found last February 9, a day after she was abducted, at the bottom of a cliff near Sayaw Beach in Barili town.

She was snatched outside her school in Calajoan, Minglanilla, in the afternoon of February 8.

Santos and Griffiths were charged only last March 30 for the kidnapping and murder of the six-year-old girl.
