They should just let the pajero go i guess. They already have the bloodstained blanket. That should probably put in circumstantial evidence.

But under the law, if evidence is in plain sight of a law enforcer he can seize the items WITHOUT a warrant. i.e. He knocks on your door and you open it. He sees behind you your stash of marijuana and an unregistered 9mm beretta. Or he can see you evidently as wasted. He can enter your home without a warrant out of "just cause".

Items being kept as admissable evidences:

The judge said the court will keep the bed sheet with suspected blood-stains, USB and card reader, video cam with accessories and tapes, the blanket and mattress with suspected bloodstains and the bed and table.

This is something to look for. Checking of the blood stain if it came from ella. Btw, all of these infos are coming from NEWSPAPER or ONLINE NEWS (emphasizing the caps for a purpose ) You have the right to believe it or not.

Tampering of plate ‘happened’ when Pajero was with police

THE alleged tampering of the license plate of the Pajero believed to be used in the abduction of Ellah Joy Pique happened while the vehicle was under the control and possession of the police, the defense said in a court pleading filed yesterday.

In the pleading, defense lawyer Rameses Villagonzalo asked Judge Meinrado Paredes to deny the partial motion for reconsideration the police’s lawyers filed.

Paredes, presiding judge of the Regional Trial Court Branch 13, earlier denied the motion Santos’s lawyers filed to quash the search warrant.

The Criminal Investigation and Detection Group (CIDG) 7 applied for the search warrant from Paredes and used it to raid the house of Santos on March 4, believing they could find evidence that could help them resolve the abduction and slaying of six-year-old Pique.

The Mitsubishi Pajero was among those seized from Santos’s house.

After several hearings, Paredes ordered the return to Santos of the 10 items, including the blue Pajero, which is considered crucial to the investigation of Task Force Ellah Joy.

“There was no authority for the CIDG to seize a Pajero with plate number LMJ 382. The applicant and the witness led the court to issue a search warrant for the seizure of the vehicle with plate number LHJ 382,” Paredes said in his order dated April 7.

Villagonzalo, together with Santos and some of her supporters, went to the CIDG 7 headquarters last March 8 to recover the Pajero.

But the CIDG 7 prevented them from taking the vehicle, arguing that their lawyers – Inocencio dela Cerna and Glenn Condor – filed the motion for partial reconsideration and asked Paredes to retain custody of the vehicle.

The defense later asked Judge Paredes to cite the CIDG 7 and its officer in contempt for their refusal to return the Pajero to Santos. The court will tackle both motions tomorrow.

In their opposition to the CIDG’s motion for partial reconsideration, Villagonzalo said the argument of the prosecution that the tampering occurred before the seizure of the Pajero is “contrary to facts and records of the case.”

“At this juncture, it should be mentioned that it is highly improbable for all the people present during the implementation of the search warrant to have been mistaken as to their recollection of the plate number,” the pleading read.

The defense also cited the March 8, 2011 issue of Sun. Star Superbalita showing the photo of the Pajero bearing license plate LMJ 382.

Thus, Villagonzalo said they established that when the Pajero was seized, it still bore un-tampered license plate LMJ 382. “The CIDG clearly was the one that had control and possession over the vehicle,” said Villagonzalo in their motion.

No, 5 out of 6 numbers is NOT enough when it comes to the legality of a search warrant. The CIDG search warrant listed a specific plate with 6 characters, and they seized a vehicle with only 5 of the 6 being correct. As I mentioned in an earlier posting (maybe you didn't read the earlier postings), I frequently see two white Honda civics with virtually identical license plates parked in a nearby mall parking lot. The cars are often times parked within 50 feet of each other. Only one letter is different, just as in the case of the Pajero. If you seize the wrong vehicle, you are indeed barking up the wrong tree. So you see, one character off in the license plate is a HUGE deal.
