Well, it doesn't matter. My suggestion is, instead of giving an infraction, its much better if Mods would heed a warning to those offenders. This might also give users the idea that they should read Forum Rules and not to make the same mistake again.

    @ SKULLS ...

That is true pod based sa akong observations , if it needs to be improved then mas maayo on an individual basis but ang bottomline gihapon is as long as naa sa perimeter ang basis sa action sa mods in moderating sa rules and regulations , mao lang gihapon na ang mo tigbabaw .

I want to repost this point I mentioned in another thread:

The internet is a medium, much as "air" is the medium to conduct speech. As thus, like you cannot own "air" you cannot own "the internet". This is perhaps the reason why people keep clamoring about fairness, bias, etc., because they feel they have the "right" to free speech and non-bias in "the internet", and since a place you technically cannot own can be equated to a public place, people tend to see that participating in an internet forum like iStorya.net is a public activity, much like someone exercising free speech at a public plaza (not owned by anybody).

However, here comes the clincher--a specific venue (such as iStorya.net, which requires a server or several servers, which is private property, to run) is something that can be owned. A forum/bulletin board is indeed a venue for discussion. Since a venue can be owned, an internet forum therefore, is private property.

Here is what ExpertLaw Online has to say about it.
Internet Privacy Laws and Private Messages

"As a general rule, any post you make on a forum owned by someone else - public or private - becomes the property of the forum owner, unless otherwise noted. This is typically explained in the TOS.

    This is not illegal.

With respect to the other forum owner banning you, she doesn't need a reason to ban you. Internet forums are owned and operated by individuals and are private property. No one is obligated to allow you onto their private property, you may be banned from a site because it is Sunday or some other day ending in Y.

This is not illegal, either. "

^^ I suppose as the forum is privately owned then responsibility for published content must then belong to the operators as the users in essence give up the rights to their posts after hitting the submit button?

Which is exactly why the forum needs moderators--most people think mods are there to berate, to sermon, to make lives miserable for everyone, when they only have one simple basic task--to clean out the trash.

ANALOGY: There's a party in a private venue. Someone brings in a rocket/firework (kwitis). During the party, that guest lights up his kwitis, but it fails to ignite/fly. The party then ends, everyone goes home. Suddenly, the next day, the kwitis launches, and hits a man walking on the street outside the property. Since the rocket came from the property, the injured man will complain against the owner of the property, rather than the party guest who owned the rocket, because the rocket got launched from that property. It was the job of the owner/caretakers of the place to have cleaned up the rocket, but that job got neglected.
