Case to be filed against supects ‘this month’

Charges will be filed against the suspects in the kidnap and murder of 6-year-old Ellah Joy Pique before the end of March, said Senior Supt. Patrocinio Comendador.

Comendador, head of Task Force Ellah Joy, gave reporters no definite date as the victim’s father Renante said that he was not in a hurry for the case to be filed.

“We have to follow the process. We want to avoid committing another mistake,” Renante said in an interview.

Renante was referring to the filing of kidnapping with homicide charges against Norwegian national Sven-Erik Berger and Cebuana fianceé Karen Esdrelon.

The charges were junked by the prosecutor’s office for “insufficiency of evidence” after the couple managed proved their alibis.

Renante is coordinating with the interagency task force led by Comendador.

Renante said the task force has seven witnesses: two friends, two habal-habal drivers, two children and an “insider” who may have personal knowledge of the crime.

Authorities, Renante said, are just waiting for the result of the DNA test on bloodstains taken from the seat of the Mitsubishi Pajero owned by Santos.

The items were sent to Camp Crame in Manila for verification.

Renante said the bloodstains will be compared to Ellah Joy’s blood taken from the blanket with which the girl’s body was wrapped

But the lawyer of the British national and Cebuana Bella Ruby Santos who were linked to Ellah Joy’s death is optimistic that charges against her clients won’t prosper.

“They are barking up the wrong tree. They have no concrete evidence against my clients,” lawyer Ana Luz Cristal told CEBU DAILY NEWS.

Cristal said they can “sufficiently establish” the whereabouts of Bella Ruby Santos and Ian Charles Griffiths from Feb. 2 to Feb. 9.

She said the three children who claimed to have seen the abduction earlier pointed to Norwegian ntaional Sven-Erik Berger and Karen Esdrelon.

“We sympathize with the Pique family. We are outraged with what happened to Ellah Joy. We want justice for her and her family. (But) we want the name of my clients cleared,” Cristal said.

Santos is renting an apartment in Makati City while Griffiths is staying in Singapore.

They are being investigated by authorities after the Mitsubishi Pajero, which was purportedly used in the crime, was found inside Santos’ residence in barangay Inayagan, Naga City.

The British national stayed inside Santos’ residence before they went to Singapore last Feb. 9.

Since then, only Santos went back to the country.

Renante said he hopes to see Santos and Griffiths in court.

@Necrotic: I didn't say that I was "sure" about daylight or darkness. I only pointed out that the detailed description provided by the wits would indicate that there was enuf light to clearly see the guy and the vehicle from 75-100 feet away. You go outside tonight on a dark street and see how clearly someone looks from that distance if you don't believe me. See if you can clearly read the lic. plate while you're at it. That's also why I raised the question about street lights... If it was YOU that was under suspicion, maybe you, too would be concerned about those important points...

the 2 witness rode a motorcycle, i think the headlight of the motorbike is enough to see the description of the suspects aswell the the license plate.. it wasnt mention also that the suspects vehicle lights were turned off. if you have a vehicle you know that license plate must have a small light. you can always see its numbers even in the dark unless it's engine and light were turned off.. but again, we can only do speculation we really know what really happened..

the 2 witness rode a motorcycle, i think the headlight of the motorbike is enough to see the description of the suspects aswell the the license plate.. it wasnt mention also that the suspects vehicle lights were turned off. if you have a vehicle you know that license plate must have a small light. you can always see its numbers even in the dark unless it's engine and light were turned off.. but again, we can only do speculation we really know what really happened..

Few things to consider:

- Witnesses stated that they saw a Pajero slowly traversing the national road
- The Pajero stop and park beside the road near Sayaw Beach
- They said the male foreigner “pulled out something from the rear portion of the vehicle—a white rolled object, seemingly a size of an ordinary sack—and placed it on top of the cemented dike beside the road. A few seconds after, the said white object was dumped off to the cliff.”

With the above scenarios, I don't think its possible that they could saw those three instances while riding on their motorbike. They will probably stopped and check these people if they found them suspicious. Or it could mean they are following the vehicle?

The time they saw these people could be of much help too, but sad to say it wasn't mentioned on the news article.

One thing is certain: The newspaper reports aren't providing us with much detail. The cops seem confident enuf to claim that they will file a complaint by the end of the month, but they don't have the DNA results back yet. I don't think that I've seen any reports that the stains found in the Pajero have even been confirmed as being actual human blood. That will be determined by the lab in Manila, I guess... The attorney for the Pajero owners seems to be very confident that the lab results will be negative and will free her clients from suspicion. And meanwhile, the cops list of "material witnesses" grows longer by the minute...

Mister Necrotic, if you were going to dispose of the body of a child that you had murdered, would you choose to do it while 2 witnesses on a motorcycle were watching you, either in daylight or at nite, bathed in the bright light of their headlamp? Would you make an attempt to clean your car afterwards, or just let it sit there in front of your house and wait for the police, knowing that witnesses had seen you..? Those are questions that one might ask himself when looking logically at this case. The police are too eager to redeem themselves in this investigation, and that is what worries me. I only wish that I had access to the actual police reports for a few hours... So many gaps, so many inconsistencies, and so little headway gained after so many weeks of investigation.

If your assessment on their investigation has so many gaps, so many inconsistencies then why not join with the investigators? If you think you're much capable compare to them. Are you a cop Mr. Vince?

GISUPAK sa Criminal Investigation and Detection Group (CIDG) 7 ang motion to quash nga gisang-at sa kampo sa bag-ong gitumbok nga suspek sa pagdagit ug pagpatay kang Ellah Joy Pique.

Ang abogado sa CIDG nga si Atty. Inocencio dela Cerna Jr. nitumbok nga ang search warrant nga gigamit sa pagronda sa balay ni Bella Ruby Santos niadtong Marso 4 diin nasakmit ang Pajero ug ubang mga ebidensya legal.

Nipadayag si Dela Cerna nga dihang naisyu ang search warrant ang huwes “had complied with both substantive and procedural rules” ug ang ebidensya nga napresentar na-establisar niini ang “probable cause” aron mapakanaog ang warrant.

Kabahin sa gihisgutan sa kampo ni Santos nga illegal ang pag-implementar sa search warrant, nitumbok si Dela Cerna nga di kini katuohan.

Iyang gisaysay nga ang testigo pabor kang Santos nga nipasangil nga may pangabuso sa mga awtoridad dihang gihimo ang pagronda busa di angay hatagan og gibug-aton ilabi na ang gisaysay ni Rolan Arao.

Nitataw siya nga si Arao nipirmag certification nga nagkanayon nga diha siya sa tanang panahon ug nakasaksi sa pagpatuman sa search warrant nga “was done in an orderly manner, no unnecessary force was employed, nobody was hurt nor was there anything lost nor property taken without proper receipt.”

Gawas niini, nipirma sila si Inayagan, Naga City Barangay Kapitan Narciso Tablate lakip ang iyang tanod sa mga butang nga gisakmit sa kapulisan.
