I feel that the police investigators and prosecuters involved in this case got a lucky break when the earthquake disaster in Japan took their problem-riddled investigation out of the spotlight. They've botched it from day one, probably to the point of never being able to solve this terrible crime or construct a believeable case against anyone involved. Anyone with experience in the "real world" criminal justice system knows how weak a "witness I.D. only" case is. Little emphasis is placed on a witness or victim's ability to positively identify a suspect in any crime (lacking add'l evidence), and when attempting to use a witness I.D. during an investigation. There are strict procedural guidelines which must be followed to insure impartiality. That obviously was not the case in the arrest of Berger and his fiance. The same is true with the "circumstantial evidence" provided by the police in this case of the Pajero seizure and suspicion of its owners ("they had the means, motive and ability to commit the crime"). What was the motive here? What exactly are the "means and ability" here? This investigation and prosecution has from the start been a "presumed guilty unless you can prove you are innocent" fiasco. It is the exact opposite of the foundation of the criminal justice system, wherein you are innocent until proven guilty.

What I want to see is some PHYSICAL EVIDENCE linking the suspect(s) to the abduction and murder of this child. Do the police even know what crimes were commited? In order to guarantee that justice would be served, the police personnel involved in this investigation should have realized their own limitations and solicited outside help at the onset of this tragedy. Homicide investigations should be handled by experienced HOMICIDE INVESTIGATORS, not police chiefs or other gov't officials with little or no real investigative expertise...

Briton, Cebuana won’t run from Ellah case, says lawyer

The two new suspects in the kidnap-murder case of 6-year-old Ellah Joy Pique will make themselves available in Cebu once charges are filed against them, their lawyer said yesterday.

Lawyer Ana Luz Cristal said Bella Ruby Santos, a Cebuana, is staying in an apartment in Makati City while British national Ian Charles Griffiths is staying in Singapore.

No charges have been filed against them yet but the name of Santos and a foreign national who was not identified were singled out by police in their application for a search warrant that said the couple was responsible for the Feb. 8 disappearance and death of Ellah Joy.

The woman’s Mitsubishi Pajero was confiscated from her residence in barangay Inayagan, Naga City.

The Cebu City Provincial Police Office (CCPO) said it expects to file criminal charges in early April.

“Leaving the country is crazy. Santos’ credibility would be destroyed if she leaves. There is no reason to flee. I assure the court and the people of Cebu that she will come here (Cebu) if ever needed,” Cristal said.

Cristal went to the Palace of Justice yesterday morning to check whether the Criminal Investigation and Detection Group in Central Visayas (CIDG-7) submitted their comment on the motion to quash the search warrant issued against Santos by Regional Trial Court (RTC) Executive Judge Meinrado Paredes.

As of yesterday, no comment was filed yet by the police.

Cristal told reporters that Santos received “death threats” on her cell phone and plans to hire security personnel to protect her.

“There are threats against her life. I don’t know where the messages came from, ” Cristal said.

She said Griffiths was furious after learning through online reports that he was linked him to Ellah Joy’s death.

She said the Briton was understandably upset.

“The important thing is Griffiths’ name will be cleared. He’s more than willing to come over (to the Philippines). He is not hiding himself,” Cristal said.

Griffith’s name came up when Santos surfaced to defend herself and oppose the police search of her house.

The British national, a longtime companion of Santos, stayed in Santos’ residence before they went to Singapore last Feb. 9. Santos flew back after her house was raided.

Santos requested the court to “quash” the search warrant issues against her.

The CIDG-7, which implemented the search warrant, petitioned the court to secure custody over the evidence gathered at Santos’ home including the Pajero obtained last March 4.

Cristal said Santos is contemplating on hiring a “private detective” conduct a separate investigation on the case.

Ellah Joy's father Renante, in a separate interview, said he shall meet Santos and Griffiths in court.

Renante said he was being kept up to date by the Police Task Force led by Senior Supt. Patrocinio Comendador.

He said the authorities are just waiting for the result of the DNA test on bloodstains taken from the seat of the Mitsubishi Pajero owned by Santos.

The items were sent to Camp Crame in Manila for verification.

Renante, along with his wife Ligaya and two children, attended a mass held at the Calaojan Elementary School in Minglanilla yesterday afternoon to commemorate the death of Ellah Joy.

Ellah Joy was kidnapped by a woman and Caucasian male outside Calaojan Elementary School in Minglanilla last Feb. 8.

The girl's body was found wrapped in a blanket and thrown off a cliff in Barili town, south Cebu the following day.

I can understand why Griffiths is reluctant to return to Cebu. Based on what happened last month to the Norweigian fellow (Berger), it is likely that he, too would be immediately taken into custody at the airport and held for weeks in jail while the authorities try to figure out their next move.

One of the many things that disturb me about this case are the "illogical scenarios" that keep staring me in the face. An example: If I were disposing of the body of a child that I had kidnapped and murdered, would I do it during daylight hours, with at least 2 witnesses only 75 - 100 feet away? Would I use my own car, with the lic. plates attached? Would I take my gf with me when I disposed of the body? Would I then drive home and NOT clean the car thoroughy? Would I leave the sheets (with possible bloodstains) on the bed and continue sleeping on them?

Another thing that bugs me about the witnesses: Why did they pay such close attention to the Pajero that day? A guy threw what looked like a bag of garbage over an embankment. That's not such an unusual thing to see (look over the side of any bridge and see how many bags of garbage are dumped there daily). Did they write the plate # down and then contact the police? Was this info contained in the initial initial investigation of Berger? How many bags were found near the body of the young girl, and was this witness info the tip that led the police to the discovery of her body?

Also, do they only focus on the confiscated Pajero? How about hair strands or fingerprints on the bed sheet used to wrap ella's body? Nowhere on the witness statements that the perpetrators used gloves so 100% there are fingerprints.
