Good day! I just want to share my two cents on this...If my memory serves me right, the only law that prohibits pets inside an abode because of noise is Condominium Law. There's a law though against noise as public disturbance. However in case of village or subdivision, the home-owners or in case of apartment or boarding house, the lessors and lesses can agree to it in a contract. Therefore, if such stipulation is not existing in the village, then the foreign national's action was violative of the dog owner's right as a home-owner. However even if there's such stipulation, he has no right to take the law into his hand because the law provides also a proper way of airing grievance. He could have file a complaint to the home-owners' association officers or at the Barangay.

Now with regard to the dog-owner, if you can prove that there's damage caused by the foreigner's act; if such act was done due to hate, revenge or other evil motive; and he deliberately caused damage ( Art. 327 of Revised Penal Code, elements of Malicious Mischief), then you can file Malicious Mischief at the Barangay before filing it at the regular court. The elements of the crime must be present because mere intention to commit a crime is not yet punishable under the law. For it to be punishable, the intention must be coupled with act by the perpetrator. You can also file a complaint to the home-owners' association officers to the effect that he violates your rights as a home-owner to peace and to owning a pet.

however, we warned him if he will do it again we'll be forced to sue him. btw, this guy already had an existing complaints before filed by another neighbor because of throwing fire cracker inside their fence because of dog also. na blotter to sa among barangay. pero ang barangay murag dili interesado mo apprehend kay walay makasugakod ug eninglis. hehehe another one kay na blotter pod siya sa police station gyud kay nay babae nga ni reklamo wala daw siya bayari pag human. hehe police were there in his appartment but he did not come out.
