CEBU, Philippines - Four Cebu City policemen were hurt and their vehicle damaged while they were assisting the Talisay City Police who tried to serve a warrant of arrest on Joavan Fernandez early dawn yesterday in barangay Mabolo.
Joavan, the controversial adopted son of Talisay City Mayor Socrates Fernandez, was able to elude arrest, but two of his alleged buddies were arrested.
Acting on a tip that the younger Fernandez was on his way to Cebu City from the town of Compostela, the Cebu City and Talisay Police tried to set up a way to trap him and serve a warrant issued by Municipal Trial Court Judge Mario Manayon.
The warrant was for the charge of malicious mischief filed by the Talisay City Police against Joavan for allegedly bumping their Toyota Innova patrol car last October 31, 2010 at the Cebu South Coastal Road.
The police spotted a maroon-colored Toyota Revo bearing plate number SGH-541 parked along the road in sitio Sindulan, Mabolo. Later, they saw a silver-colored Honda Civic bearing plate number YEH-323 approaching the area.
The car matched the vehicle that the informant gave the police and they followed it. The car went past the parked Revo but made U-turn several meters ahead and later stopped across the street from where the government-owned vehicle was parked.
It was at this point when Chief Insp. George Ylanan, head of the Investigation and Detective Management Branch (IDMB) of the CCPO went down from their vehicle and introduced himself to the car’s driver, who was Joavan Fernandez.
While Ylanan was trying to inform Fernandez why he was there, the latter reportedly revved his car and looked like he was going to run.
Sensing danger, Ylanan ran towards the pick-up of the IDMB, which they used to block the road, and just as he managed to get inside the vehicle, Joavan allegedly sped off and hit the police vehicle.
Ylanan said that he got out of their vehicle and fired five shots at the Honda Civic hitting the right rear tire, but Fernandez continued to drive towards Juan Luna Ave. then turned right to the North Reclamation Area.
The car was later found abandoned at sitio Bagong Buhay in barangay Carreta. People in the area said that they saw the driver of the car hail a taxi, but they could not tell where it was headed.
Ylanan said that he vomited twice after the incident, but was not bruised.
“Nagdali kog sakay kay ako may maigo ato, wa ko kaandam murag natay-og akong utok sa kakusog,” Ylanan told The FREEMAN on the phone.
Police Officers 3 Alner Maglinte and Melbert Dio and PO1 Allen Dignos, who were on board a motorcycle, suffered bruises when Joavan’s car allegedly sideswiped their vehicle and they fell into a ditch.
A team from the Talisay City Police headed by Supt. Henry Biñas was also in the area hoping to provide a blocking force. They were, however, caught flat footed when Joavan made a U-Turn and headed back north.
The police surmised that Joavan saw the Talisay policemen, which was the reason why he made a U-turn.
While the commotion was ongoing, two men, who were on board the Revo tried to run away, but were arrested by pursuing policemen.
The two were identified as Benedict Gabasa and Terence Bayani.
Gabasa is the same person, who was arrested by Cebu City Police several months ago after Joavan had an altercation with a guard on an uptown mall.
In that incident Gabasa was arrested for driving a vehicle owned by the Talisay City government even if he had no license.
Confiscated from Bayani was a disposable syringe containing liquid substance believed to be Nubain.
Police found a medium pack of shabu and drug paraphernalia in Gabasa’s possession.
The IDMB personnel together with the Scene of the Crime Operatives (SOCO) also recovered 20 small transparent plastic packs believed to contain shabu placed inside a small pink pouch and two cellular phones inside the abandoned vehicle of Joavan.
The suspected drugs are now with the Philippine National Police Crime Laboratory at Camp Sotero Cabahug to determine if they are indeed illegal substance.
The Honda Civic and the Toyota Revo are also in the custody of the Crime Laboratory.
Ylanan said that despite what happened they will use all legal means to arrest Joavan.
“We are ordered to capture and not to kill kay if our intention is to kill gi-unhan namo siya,” he said.
He however warned his fellow men in uniform who might be involved in future operations against Joavan.
“Ako jud ingnon sila nga si Joavan wa gyuy utok. Ayaw mo’g kumpiyansa kay buang-buangon na,” the police official said.
Gabasa and Bayani will face charges for violation of Republic Act 9165 or The Comprehensive Dangerous Drugs Act.
A separate case for violation of City Ordinance 1743 will be filed against Gabasa after he was found with a toy gun and another violation for driving without license.
An additional case for damage to government property will be filed against Joavan.
The police are yet to determine which government entity owns the Revo.
INCIDENT SADDENS VIDAL
Cebu Archbishop Emeritus Ricardo Cardinal Vidal expressed his sadness over the recent brush with the law of Joavan.
This is because his father, Mayor Fernandez, is one of lay leaders of the Catholic Church.
Vidal describes the incident as “unfortunate and sad,” adding that Mayor Soc is one of his “co-workers” in “explaining the doctrine of the Church.”
“I just wonder why it takes him difficulties to apply these (doctrines) to his own family,” Vidal said.
Vidal believes that in order for Mayor Fernandez to effectively teach, he should first successfully apply the teaching of the church to his own family so that others could also follow without contest.
The Cardinal, however, assured Mayor Fernandez that he is constantly praying for him to find ways “to correct his beloved son.”
The Cardinal said that he is also willing to help the elder Fernandez with his problems, but he will have to wait for the mayor to ask him.— with Ryan Christopher Sorote/NLQ (BANAT NEWS)
