Criminal raps dropped against ‘Black Suede’ docs

THE Office of the Ombudsman in the Visayas dismissed the criminal charges filed against seven doctors, five nurses and two clinical instructors involved in the “Black Suede” scandal two years ago.

“Unfortunate as it is, there lies no adequate showing that the incident ought to be made the accountability of public respondents,” Sarah Jo Vergara, graft investigation and prosecution officer, said in her resolution.

Vergara said there was no evidence which proved that the video footage as seen on YouTube was taken by the respondents.

Nor was there any proof that anyone of them uploaded it, she added.

The footage showed the doctors and nurses making fun of the victim while they extracted a Black Suede body perfume canister from his rectum.

tried to contact lawyer Guiller Ceniza, the victim's counsel, but calls were left unanswered.

Basak Pardo Barangay Captain David Tumulak, who helped the victim in filing a case, said he and Ceniza hadn't received a copy of the resolution.

“The video speaks for itself and those who are responsible,” Tumulak told CEBU DAILY NEWS over the phone.

The respondents whose case was dropped include Dr. Philipps Leo Arias, the surgeon in-charge; Dr. Angelo Linawagan, assistant surgeon; Dr. Marlowe Parreno, and Dr. Serapio Salazar; medical specialists; Dr. Joseph Alfred de Leon, assigned in documentation; Dr. Joanne Mae Merilles, resident anaesthesiologist; and Dr. Max Joseph Montecillo, medical officer.

The anti-graft office also dismissed the charges filed against five nurses—Isabelita Remulta, Consuelo Tecling, Ida Sumayang, Carmenia Sapio, and Rosemarie Villareal.

The charges filed against clinical instructors Ramon Pandaan and Alexandru Oplado, both of the University of Southern Philippines, were beyond the jurisdiction of the anti-graft office.

Danilo (not his real name) filed charges against the respondents for violating Republic Act 3019 or the Anti-Graft and Corrupt Practices Act.

Danilo, a florist, underwent a surgical operation at the Vicente Sotto Memorial Medical Center (VSMMC) on Jan. 3, 2008 to remove the Black Suede canister from his rectum after a night of *** with a stranger on New Year's eve.

One of the persons present during the operation took a video of the proceedings and uploaded it on the Internet.

The video showed doctors, nurses and medical students in the operating room laughing and spraying the nozzle of the can while the patient was left unconscious.

It was only on April 11, 2008 when Danilo knew about the video.

The anti-graft offfice earlier ordered the six-month suspension of Arias for “conduct prejudicial to the best interest of the service.”

Arias has transferred from the VSMMC to the Visayas Community Medical Center.

Dr. Linawagan, Dr. Merilles, Dr. Montecillo, Dr. De Leon and Sapio were also mandated to serve a suspension for a month and one day without pay after being found guilty of “simple neglect of duty.”

They were sanctioned for failing to “restrain unauthorized presence and improper conduct during the medical procedure.

A nursing student Roberto Wade Fajardo had confessed that he uploaded the video on YouTube.

The anti-graft office said there is proof that the respondents conspired with Fajardo.

Vergara, however, slammed the respondents for failure to perform what they ought to do.

“Public respondents may have been remiss in their public duties to strictly monitor the conduct of the people present during the subject medical procedure,” she said.
