if they don't like willie anymore, dapat unta pasagdan na nila si willie. sa pagka ngan nga naa siyay offense sa iyang dati nga network. haha pildi man gud sila sa kaso unya si willie nanghakot og more audience and sympathy for tv5 lol.
I don't know about "concept copyright" but this case has something to do with intellectual property or the "idea".
Here's another article stating the law:
Anyway, I'm not interested in both parties, kng kinsa nila ang sakto or saup, dumot or ng.apas. I'm more interested in how this case goes. Which one of them has the right and what the law really states, I'm more into learning what copyright really means because copyright is a complicated thing, it's not just about putting a watermark of your name/company in every footage. A good example that everyone knows is the "Pilipinas, kay ganda" brand. DOT Sec may be right that "Polska" has no copyright on that, etc, but...you know what comes next.ABS-CBN hits Willie Revillame with P127-M copyright case | The Manila Bulletin Newspaper Online
MANILA, Philippines - ABS-CBN has filed a P127-million copyright infringement suit against estranged talent Willie Revillame, his company Wil Productions, Inc., and the president of his new home network, TV5's Ray Espinosa.
The Kapamilya network, through a 33-page complaint filed before the Makati Regional Trial Court on Nov. 24, claimed that the parties in question “deliberately and intentionally imitated ‘Wowowee,’” a top-rating noontime show which Revillame previously hosted on ABS-CBN, thereby violating section 172.2 of the Intellectual Property Code.
Section 172.2, under Chapter Two of the IPC’s Law on Copyright, states that “works are protected by the sole fact of their creation, irrespective of their mode or form of expression, as well as of their content, quality and purpose.”
These “works” are defined under section 172.1 as “original intellectual creations in the literary and artistic domain protected from the moment of their creation.”
ABS-CBN claimed that they own the copyright of “Wowowee” since they are the producer of the said show.
Revillame is currently hosting a variety-game show on TV5 called “Willing Willie,” which, ABS-CBN alleges, is "undeniably a copycat of Wowowee,” thus “[stealing] the goodwill that ‘Wowowee’ has built over the past 5 years of airing in ABS-CBN."
The network enumerated in the same complaint, the portions on “Willing Willie” which allegedly bear striking similarities to “Wowowee.”
These include the production number done at the beginning of the show; segments called “Big Time Ka” and “Willtime Bigtime” which are allegedly similar with “Wowowee”’s “Biga-Ten” and “Willie of Fortune,” respectively; “Willing Willie” dancers and other characters who previously appeared on “Wowowee”; and even lighting, camera angles, studio audience seat layout, stage and set design.
The TV host had also signed a contract with ABS-CBN which they stated includes the following statement:
“Talents acknowledge that ABS-CBN is the sole and exclusive owner of the copyright of its shows in which he/she is to appear and that he/she waives or assigns, whatever moral or other intellectual property rights he/she may have in the show.”
TV5’s continuous airing of “infringing work ‘Willing Willie,’” the Kapamilya station added, “has caused and continues to cause irreparable damage to ABS-CBN.”
Apart from the copyright infringement case, ABS-CBN also asked, for the third time, the court for a Temporary Restraining Order (TRO) and/or a Writ of Injunction to stop the production and airing of “Willing Willie.”
The Quezon City Regional Trail Court, under the sala of Judge Luisito Cortez, as well as the Court of Appeals, have dismissed the previous TROs that the network sought.
I can hate ABSCBN all morning, but at the end of the day ABSCBN ra ghpn ko magtinan.aw..you can't blame me, let's face it, they have better productions than other networks, better video qualities, more famous artists, may it be their shows are copied or not, they are still doing better with production. Good for them wla si gkasuhan sa ila gikopyahan sa ila shows, bad for TV5 kay ABSCBN knows how to sue. It's only the management that is screwed. Yes they are bitter and a crab, I hate their management/admin, but I don't care about their management, as long as they give me good shows then I'm enjoying it..
IMO, I think it's normal to be a crab in this industry, they are of the same industry, they are running the same business and they want to be better than their competitors, IMO it can even help the entertainment industry to be better and think of their own ideas. They can pull eachother down if they go against eachother's rights. But crab mentality is not ok/normal in the government, there's only one govt and they don't have a competitor, so why pull eachother down, that's where it becomes bad.
Again, I don't care about ABSCBN or Willie. I care about the law, who's abiding it and who's not. Just my 2 cents, there's always 2 sides to a story.

Naa lng ko suggestion, since this thread is about copyright infringement, why don't we discuss:
"Does ABS-CBN have the right to claim copyright on Willing Willie?"
But, let's set aside the fact that Willie is the host, let's set aside the issue about ABS and Wil contract, etc. Set aside the fact na bitter ang ABSCBN, let's stick to the issue of LAW. Let's keep it plain and simple.
"Does ABS-CBN have the right to claim copyright on Willing Willie?"
When we say copyright, it's like this:
Kita naman mo sa commercial sa Nestea Ice tea diba? The "ayoko maging SMP...". Then Tang made a fairly similar commercial, but instead of having his family there, they had the friends instead, they changed the script a bit but the idea is still there, nagreklamo siya ky g.busted siya, the "same idea". In short, intellectual property, "the idea" is the same, that when you see that commercial, it makes you say "Hala! pariha2 lagi sa nestea", now incorporate it to Wowowee and Willing willie. Just like when you watched Willing Willie, "Pariha2 jud lagi sa Wowowee? Pariha og porma ang set, same sequence sa segments."
Let's set it like that, "Does ABS-CBN have the right to claim copyright on Willing Willie?"

hasola aning abs cbn wui... hope they can get along..^_^
kato vp sa current affairs or news something, kato connected sa CNN news ne resign gud sya... forgot her name... this person was the one responsible for eliminating korina sa bandila and not having noli de castro on the lime light after his term. coz she implemented this policy na if mangompanya gane for a candidate (like what korina did) or ng-serve as govt official like Noli de castro mura naa man to 1 or 2 year ban na dili ibutang sa lime light of delivering news... kay matod pa nya unsaon man daw pagdeliver sa news and not be biased if more or less associated sa politics...nya karon? shocking ang show... a month ago or 2 months ago bato na ne resign to vp sa news, then here comes the new format na si korina og si noli de castro ang mo anchor sa TV patrol which airs at 6:30 which is 30minutes after willing willie will show on air everyday kay 6pm-9pm man ang show ni willie... ang abs desperate na au to capture the viewers on willie's show para mo tan-aw og news.[/quote]
her name is maria ressa, former CNN senior correspondent..she voluntarily resigned, opt to out silently coz she understand what her contract says and temporarily replaced by Ging Reyes (ANC US Media Bureau Head)..and she cannot transfer or apply to any local media (GMA,TV5,NBN etc)..Why? because very specific iya contract (as agreed between her and ABS) nga dili cya pwede motransfer sa local media..outside ra cya sa Pinas pwede cya mo-apply like CNN or BBC etc..and maria ressa is not just an ordinary woman (she authored a book entitled Seeds of Terror -- details about Al Qaeda).. going back to willie's case, does abs-cbn has the right to file infringement case against him? it boils down to legalities and knowing ABS -- who can always tap the most powerful circle of lawyers around the country.. its a long way to go..hoping the best for willie..
hope willing willie would prosper..![]()
