CEBU City Mayor Tomas Osmeña blew his top yesterday just as he was about to sign a 30-year contract for the water supply in the South Road Properties, which he said included "dubious" provisions that could have the City giving away SRP lots to the consortium-supplier.
In front of city officials and consortium investors, Osmeña demanded an explanation of the details of the contract. And when no one could explain it, he asked to cancel the contract signing.

The champagne, wine and food prepared by the caterer for the visitors were also cleared, following the mayor's order that they get out of his conference room.
"Why are we giving the land to you? Why are we giving the facilities to you? You don't even specify the size of the land, then we'll give it to you and it will be owned by the joint venture? No one can answer that? Then cancel the whole thing," an angry Osmeña told officials of the consortium, among them businessman Michel Lhuillier.
"How come I was not informed? I should be informed, I'm still the mayor here," he continued.

But after the City's Joint Venture Selection Committee revised the contract, Osmeña signed the deal with the consortium of Pilipinas Water Resources Inc. (PWRI), Mactan Rock Industries and Lhuillier.
The suppliers entered into a joint venture with the City Government to operate the City's two desalination plants in the SRP and supply water to the locators there for 30 years.
The contract-signing was delayed by two hours because the mayor ordered revisions in the 11-page contract.
Instead of "contributing land to the joint venture," the City's obligation to the suppliers in the contract was changed to "allow the use of land… for the desalination plants, wastewater treatment facilities, pipelines, collection tanks, etc."
The contract was approved both by the City Council and the City Attorney's Office, but Osmeña lamented the wording of the contract provisions was not carefully reviewed.
"There are some dubious items that are not acceptable, like one of the obligations of the City is to contribute the land.
We're not contributing the land. It could always be interpreted that we're giving the land to the joint venture, and we're not giving them the land. We will allow the use of the land. The way they worded it, we just gave all the land away, that's why I got angry. What kind of sloppy work is this? I relied on our legal (office) to clear it," said Osmeña.

Shortly before the signing of the contract, City Attorney Joseph Bernaldez said they had to revise the contract to make sure the provisions are not open to different interpretations.
Under the contract, the consortium, through a joint venture with the City, will manage and operate the City-owned desalination plants and construct new desalination facilities and potable water distribution system facilities in the SRP.
The consortium will produce 350 to 500 cubic meters of desalinated water a day, which could increase as the operations progress.
The City stands to get P10 per cubic meter in excess of the first 30 cubic meters of potable water for every locator per month, referring to potable water generated and distributed from the plant.
It will get P5 per cubic meter in excess of the plant's original capacity of 550 cubic meters a day.

For wastewater treated in the facility, the City will get a share of as much as P5 per cubic meter and P1.50 per cubic meter for non-potable water produced from the wastewater treatment plant.
The PWRI will sell potable water to locators at P14 to P47 per cubic meter, with a graduated price scheme, depending on the consumption of the client. At no time shall the water rates be higher than the rates of the Metropolitan Cebu Water District (MCWD).
Non-potable water will cost P20 per cubic meter, while wastewater will cost P25 per cubic meter.
"I knew already the basic numbers and the sharing scheme but when I read the contract and went into the details, I said this might tie up the City in the years to come, so I had it changed… The blanket statement that we contribute the land, maalkanse gyud ang ciudad kung maro ang ilang abogado (the city could be placed at a
disadvantage if their lawyer is shrewd). Because of the way it was worded, it can be interpreted that if you contribute the land, you're giving the land to the partnership so that when the partnership ends, they sell everything, and they sell the land also," Osmeña told a news conference after the contract-signing.
Urgent
The city council held an executive session last Monday to tackle the contract, which the mayor identified as an urgent concern.
A stable water supply in the SRP is among the requirements of Filinvest Land Inc. and SM Prime Holdings Inc. before they can start developing their properties there.
William Maceren, president and chief executive officer of PWRI, said their operations in the SRP will not worsen the water shortage problem in the city.
He assured they will rely mainly on water sourced from the SRP, and that they will not tap aquifers outside the 290-hectare reclaimed properties.
Maceren said they are also open to supplying water to residential or commercial areas outside the SRP, if there is excess water after they have met the demands of locators.
"They are not allowed to sell water at a rate higher than MCWD's, so the deal is beneficial to the investors in the SRP. It's a win-win deal. The City does not stand to lose anything, but it will gain something," said Councilor Sylvan Jakosalem, proponent of the resolution authorizing the mayor to sign the contract. (LCR)
