He said the same way the Commission on Appointments cannot function without a Senate President. “My God, these people must study the Constitution first before they open their mouths," Enrile said.     Enrile is damn wrong. It is he who should study the constitution. First, the Supreme Court and its associate justices by tradition and jurisprudence is not without a power to choose among themselves an acting chief justice while the position is yet to be filled up by way of executive appointment. Hence, right after the vacancy occurs and that is when chief justice Reynato Puno steps down on Monday (May 17, 2010), it is incumbent among the remaining justices to temporarily assign one associate justice out of its 14 standing magistrates to assume the post (and that includes the authority to preside over the JBC as ex-officio chairman). Under the constitution, the president (Noynoy Aquino) is given a 90 day period from the time the vacancy occurs to choose from the short list of viable nominees duly submitted by the Judicial and Bar Council (JBC).
    Second, the JBC is but a preparatory body tasked to convene only when the need arises while on the other hand the commission on appointments (CA) is an independent constitutional creation tasked to approve appointments with finality. There is no similarity whatsoever.

    bro, wla mana sa constitution nga kinahanglan jud sa chief justice manumpa. check your philippine constitution lessons. what noy2x is doing just shows how he cares and respect the lowest part of our society. taking oath with the chief justice is only a tradition and not required in the constitution. there's a saying that goes "what is NOT INCLUDED in the constitution SHOULD NOT ALWAYS BE EXLCUDED". hope u get my point.
