Machine, signal and compact flash card problems hound AES

The automated election system implemented this May 10 relies on both the efficient performance of the machine and the transmission of the results. However, in both standards, the system failed in many areas in the country.

The precinct count optical scan (PCOS) supposedly transmits the election results in electronic form from the municipal to the Municipal Board of Canvassers (MBOC), usually holding out in the town center. However, in many areas, there is failure of transmission of data from clustered precincts to the MBOC.

Key to these developments are the breakdown of PCOS machines that either delayed automated counting or forced manual counting of votes in many areas, and totally decimated electronic transmission of results to the MBOC.

Isabela, the Rice Granary of the North, experienced several PCOS problems. In the barangays of Zones 2 and 3, and Del Pilar in San Mariano, the PCOS did not turn on, although it was okay during the final testing and sealing procedure. It was only turned on at 10 a.m.

In Barangay Villa Rey, Echague, the PCOS jammed and shut down after the fourth ballot was fed to it. It was fixed by the IT staff. In Wigan, Cordon, the PCOS machine in one clustered precinct shut down at 12 noon, but the voting continued. The Comelec officials decided to use another PCOS for the counting. In Kakilingan, Cordon, voting started only at 7:30 a.m. The PCOS didn’t turn on immediately, but was fixed.

In Masaya Sur, San, Agustin, voting started only when the PCOS machine came in at 10 a.m. In Calao West, Santiago City, the PCOS jammed and rejected all ballots fed to it. It was fixed by the Smartmatic personnel. In Balog, Tumauini, the PCOS didn’t start up immediately after the precinct was opened. Voting only started after it was fixed at 7:30 a.m.

In Nagbukel, San Isidro, the PCOS machine shut down at 11:20 a.m. and reset itself to zero. The ballots of the waiting voters were fed to the machine. In the barangays of Villa Teresita and Villa Teresita, San Guillermo, the PCOS shut down, but voting continued. The ballots were later manually counted. In Sipay, Ilagan City, the PCOS was placed beside the BEI chairperson, and the BEI members were the ones feeding the ballots into the PCOS.

PCOS problems were also encountered in the Visayas. In the Cebu City Central Elementary School, four PCOS machines failed to function throughout May 10.

In Iloilo City, of the 344 PCOS machines, nearly 300 clustered precincts failed to transmit their data to the Iloilo City Canvassing Center. This forced the Boards of Election Inspectors (BEI) in the precinct level to bring the compact flash cards to the canvassing centers.

Of Iloilo City’s 344 clustered precincts, only 76 have transmitted their results as of noontime, May 11. Iloilo City has not finished canvassing as of day-end of May 11.

As of 1:30 pm of May 11, only 28 of 41 towns in Iloilo Province have completed canvassing and were able to transmit results to provincial canvassing.

Three PCOS machines in Iloilo City were found to be defective, but were replaced, causing further delay.

In Manga District, Tagbilaran City, two PCOS machines malfunctioned, and they got fixed only at 3:40 pm. In Bingag, Dauis, Bohol, one PCOS bogged down, and was fixed only at 4 p.m. In CP-21 Tangnan, Dauis, Bohol, one PCOS went down, but was later fixed by 4 p.m. In Barangay Mariveles, Dauis, Bohol, one PCOS machine went down.

Signal problems and defective compact flash cards (CFC) caused the delay in the transmission of results. In several areas of the country, transmission was not possible even a day after the election, forcing many BEIs to physically transmit the compact flash cards to the municipal canvassing center.

Defective CFCs were noted in Tubungan, Iloilo. The CFCs used for the some PCOS machines in the barangays of Maindang and Bitoon Ilawod in Cuartero, Capiz were damaged. Until noontime of May 11, canvassing has not yet started. The BEIs in these areas were still awaiting for the new CFCs so that the ballots could be fed to the PCOS for automated counting.

In the whole of Masbate Province, only one school had signal good enough to transmit election returns as of May 11, 8 a.m. In Jose Surbito Elementary School, Masbate, election results have not been transmitted as of May 11, 8: 51 am. due to signal problems. There were no signals even if the machines were already brought to an open area outside the polling center.

In Kiangan, Ifugao, only three out of 19 PCOS machines were able to transmit to the MBOC. The CF cards and the machines were brought to the town hall, where the data in the CF cards were finally uploaded.

Two days after the election, many areas in the country have not yet reported their results. This could not but dampen people’s enthusiasm in the overall performance of the P7.2 billion automated election system put in place for the May 10 polls.

MANILA, Philippines—Hacienda Luisita, the vast landholdings whose distribution to farmers has been dodged for decades by the family of presidential aspirant Benigno “Noynoy” Cojuangco Aquino III, is bankrupt...

...Inevitably, Aquino’s reason for seeking the most powerful office is doubted; his adherence to family interests, closely watched. While his allies think that he is sincere when he promised at the start of his presidential campaign that he would distribute Hacienda Luisita to the farmers, his critics are convinced that he would bow to pressures from his family—just like his mother, President Corazon Aquino, did.

The critics have reason to be wary. In the past 3 months, Aquino has modified at least 3 times his statements on what to do with the hacienda, indicating that he does not have his own firm position on the matter. Various media reports show that just before the campaign period, Aquino said that he wouldn’t be able to dictate on HLI because it’s a private company. Days later, when he kicked off his campaign in his home province of Tarlac, he said that although his family wants to, the lands couldn’t be distributed yet because some parcels had been mortgaged with banks when some loans matured and had to be restructured.

There was a point that Aquino also said that direct distribution of lands wouldn’t be productive for farmers because each of them would get less than a hectare.

He has also issued conflicting statements about how his family intends to settle the hacienda’s debts, not helping at all to douse suspicions that they simply don’t want to let go of the property, which is said to be as big as Makati and Pasig cities combined. (Hacienda Luisita is a 6,435-hectare plantation estate located in Tarlac, the second largest single piece of contiguous land in the Phils after the 20,000-hectare Canlubang Sugar Estate of the Yulos in Laguna)

Complicating the matter was the statement made by Aquino’s first cousin, lawyer Fernando Cojuangco, in an interview with the New York Times in April—that the family has no intention of distributing the lands...

“One party is the politician (Aquino), and the other party would be the businessman (Cojuangco). It would be a big family discussion if Senator Aquino wins. If he doesn’t win then we can forget about all the promises and possibly Hacienda Luisita will remain” as such...

BusinessWorld columnist Rene Azurin is convinced that Aquino’s bid for the presidency is fueled by nothing else but his family’s resolve to keep Hacienda Luisita.

“It is reasonable to believe that Noynoy Aquino’s presidential campaign is really only about land, about a last-ditch attempt of his family to hang on to their pelf and power,” he said in a commentary.

Citing the mounting debts of the hacienda, Azurin added, “Bottom line: if he does not become president, the family will lose their wealth and power.” ...

In 2 well-publicized conversions—the 500 hectares for the Technopark, and the 80 hectares for the Subic-Clark-Tarlac Expressway (SCTEX)—the Cojuangcos gave the farmers only 3% of the proceeds, when they own 33% of HLI. HLI was paid P2 billion and P83 million, respectively for those lands.

There is a big difference between production & sale of land, he said. “They are applying the 3% share in gross production to real estate transactions. Sale of land in an agri enterprise is not production, it is sale of capital goods & assets. So [in dividing the proceeds], it should be the ownership structure that should be followed—33% for the farmers.”

This division of proceeds is flawed, according to Cavite Rep. Jesus Crispin “Boying” Remulla, who initiated a congressional probe into the overpricing of the right-of-way payment made by the government to Hacienda Luisita in connection with the SCTEX project...

Alvin takes responsibility for loss, says he’s retiring


AFTER losing the mayoral race, Alvin Garcia decided to retire from politics and to step down as leader of the opposition party Kugi Uswag Sugbu (Kusug).


In a news conference yesterday, Garcia said he took full responsibility for the loss of his whole party, saying they did not have enough money to wage a successful political campaign.

“I take full responsibility for our loss and nobody else. We did not have enough money to wage a city-wide political campaign that has become increasingly expensive. We probably did not communicate our message of change well enough and there were not enough forums to do so. We also did not anticipate the ramifications of the automated voting process wherein over 50 percent of our electorate were not able to vote…Being responsible for the loss, I now step down as leader of Kusug,” said Garcia.


Garcia passed the leadership of the opposition party to Lahug Barangay Captain Mary Ann delos Santos, Jonathan Guardo and young members of Kusug, like Atty. Raymond Alvin Garcia, Joel Garganera, Eugenio Gabuya Jr. and Danilo Lim.


“(They) will carry the torch of Kusug to the future. They will now be responsible to direct a new course for Kusug, recast its platform, advocacies and plans, recruit new members and whatever else is needed to revitalize the party,” he said.


The former Cebu City mayor, however, clarified Kusug will remain as an opposition party but is willing, if requested, to cooperate with the administration that will be led by mayor-elect Michael Rama in order to develop the city and to maximize the use of public funds.


As for his retirement, Garcia said he will still be ready to give his advice for the management of Kusug.


“I will not totally fade away into the sunset even though the shadows are lengthening for me. I will still be available for consultation and advice,” said Garcia.

Guardo said they have yet to decide on what directions Kusug will take and that they will just “stay in the sidelights for the moment.”
