this just my opinion... you mean without watchdog they cannot do there job properly or honestly? if this irregularities happens because there are no watchdog then they don't deserve the position they have. people put there trust to this officials and so they should give it that back without stain..

Yes, we should stop unproven allegations...if we do have evidence, then we should file complaints in the courts of law...after all, the right to due process is a hallmark of a democratic society...

More so if there is only one bidder left if the others failed to qualify due to technical problems like lack of permits, SEC/DTI accreditation, etc.

I can't help it if you always sound suspicious of anything...most people are... but if you have to trust the courts of law which are the duly-instituted authorities mandated by the constitution..otherwise, the only other available option are the revolutionary courts which are extra-legal and anti-constitutional.

You still fail at answering questions Pascual, so let me reiterate the most pressing question that needs answering.

IS IT OR IS IT NOT A FACT THAT SUPPLIERS CANNOT PARTICIPATE IN THE BIDDING UNLESS THEY HAVE BEEN PRE-APPROVED AS QUALIFIED BY RADAZA? In the spirit of lawyering, since you're so fond of forum lawyering, a yes or no answer would suffice. Do not try to distract the issue again by raising other concerns unrelated to the question. It is after all a simple question in plain English that even a three-year old can understand, so I would expect an internet lawyer of the Radazas to understand it as well.

Sa ilang pagreview, ang gideliver according sa record is Pentium IV jud. Unsa man pasabot ani? Gitago ug gihilom ang kamatouran na Celeron ang gideliver dili Pentium IV. The COA is part of the government process of check and balance...its usual policy is post-audit, not pre-audit...hence its resident auditor found out about the change in specs after the delivery, not before...i don't think it was purposely concealed from COA; the procedure was just so because of the latter's post-audit policy...by the way, COA also has a policy of not attending meetings aimed at clarifying transactions, etc...even if you ask its resident auditors for an opinion on official transactions, they will only say "it's your call, after all, we will only do post-audit..."

A notice of disallowance is also a normal occurrence in government agencies...there is probably no single government agency that has not received a notice of disallowance at one time or another...
still, a notice of disallowance can be subject to an appeal or a motion for reconsideration...after all, COA is not an arbitration body like the Ombudsman, the Sandiganbayan or the courts...and even these bodies' decisions are also appealable...

COA's notice of disallowances may also be lifted if a government agency can justify a transaction that has been disallowed by its resident auditors...the lifting of notices of disallowances are also a dime a dozen in government offices.

So, just because COA issued a notice of disallowance on the computer purchase, that doesn't mean that the transaction is already deemed as anomalous with finality...its decision may still be overturned by a pending appeal or motion for reconsideration...

Lucky, I commend your interest in government procedures like COA's moves...as responsible citizens, we should always uphold due process and administrative remedies provided for by law...

Your negativism is not surprising...most Filipinos today aren't happy about their country...but what can we do? This is the only country we have and to help make it strong, we must pitch in by actions and not just by words.

Let's not leave the affairs of the state to others...that's being lazy...perhaps, the reason why our nation has retrogressed badly is because its citizens do not anymore contribute positively and concretely to its progress...
