I did not read the other posts regarding this thread, but based on the clarifications made by the seller (niangkon sya nga sayop asng date sa warranty nga iyang gipost) as evidenced by the post here at ISTORYA.NET; naay breach in the deal. The seller claims that the warranty is still good for a certain no. of months but based on the discovery of the buyer, it is actually lesser than the one posted in the Buy&Sell post of the seller. This constitutes "MISREPRESENTATION OF FACTS". The "
Consumer Act of the Philippines" requires complete transparency in any transaction between a seller and a buyer.
- Since the seller claims that he doesn't know that the warranty has elapsed already, it is his duty then to REPLACE the unit or REFUND the money. WHY? Because there is a breach in the contract or transaction.
- If the seller still does not replace the unit or refund the money, then this can be reported to the Department of Trade and Industry for civil action. In this case i think a minimum of 1 month to a maximum of 6 months imprisonment plus indemnity charges will be meted to the offender (Di ko sure ani). I am not sure though.
To the Seller, settle this with the buyer so that further complication can be avoided.
To the Buyer, require the seller for a replacement of the item or if he cannot replace the unit, ask for a refund... the Consumer Act of the Philippines states that you can do this. If he still doens't do that... go to the Public Attorney's office of your city hall and they will gladly help you on this.
To the buyer, please update this thread so everyone can see if the seller is still hard-nosing you. If you have settled already, still provide update in this thread.
