    VISAYAS Deputy Ombudsman Pelagio Apostol yesterday assured stronger cases against officials implicated in the alleged overpricing of the lampposts installed during the Association of Southeast Asian Nations Summit in 2007.

    He explained that his office was taking a longer time to wrap-up the re-investigation because they had to gather more pieces of evidence.

    “It is taking us longer because we want to make sure all preparations are in order. We also do not want the delay,” he said.

    Lapu-Lapu City Mayor Arturo Radaza, one of the respondents in the case, filed a motion before the Sandiganbayan's First Division, crying foul over the approved extension for the re-investigation of the case.

    Gutierrez pressured to refile lamppost cases

    Graft charges were refiled yesterday against former Mandaue City Mayor Thadeo Ouano and several other officials involved in the lamppost scandal but Ouano’s lawyer said the timing was suspcious.

    Lawyer Dennis Aņover said he suspected that the decision of Tanodbayan Merceditas Gutierrez to refile the graft cases in the Sandiganbayan was prompted by her impending impeachment case before the House of Representatives.

    “I have a feeling that because of the pending impeachment case against the Ombudsman, she is under pressure to file whatever cases she feels necessary to somehow lessen the heat on her…,” Aņover said.

    He said he was surprised the graft cases against those linked to the alleged overpricing of the decorative lampposts were refiled when the office of the Ombudsman had previously withdrawn the cases and that its prosecutors assigned to the case admitted that “they had no case at all.”

    The refiled cases named Ouano, Lapu-lapu City Mayor Arturo Radaza, eight engineering staff from both cities, and nine regional executives of the Department of Public Works and Highways (DPWH) as respondents for their alleged involvement in the overpricing of over P300 million worth of decorative lampposts installed in Cebu, Mandaue and Lapu-lapu cities for the Association of Southeast Asian Nation Summit in January 2007.

    The Office of the Ombudsman refiled the graft cases yesterday after completing its reinvestigation.

    Lamps cases ‘just a smokescreen’

    WITH the Asean lamppost cases revived, the Office of the Ombudsman-Visayas will move that all public officials impleaded in the charges be placed under preventive suspension.

    Deputy Ombudsman Pelagio Apostol said in an interview yesterday that this is usually done after arraignment. It is mandatory under Sec. 13 of Republic Act (RA) 3019 or the Anti-Graft and Corrupt Practices Act.

    The provision states that “any public officer against whom any criminal prosecution under a valid information under this Act
    or under the provisions of the Revised Penal Code on bribery is pending in court, shall be suspended from office.”

    The lawyer of former Mandaue City mayor Thadeo Ouano said they are still waiting for their copy of the anti-graft office’s re-investigation report.

    Lawyer Dennis Aņover, however, suspects that the revival of the charges is to smokescreen the impeachment proceedings against Tanodbayan Merceditas Gutierrez.
