in our country it's not difficult to set-up policemen and judges, we all know that.Â* as for the supreme court, they just merely reviewed the case basing on what the lower court submitted and did not actually TRIED the case.Â* So their decision will be based on their correction of the discrepancies but did not ACTUALLY examine the case plus on the basis of previously decided cases.

i admit it is difficult to set-up a lot of witnesses though at different places and different times with different personal profiles and corroborating their stories.Â* however the court TOTALLY DISMISSED the testimony of the 15 or so more CREDIBLE witnesses (not because they are rich) that were with Paco that night.Â* If you remembered how the case ran, the Judge almost NEVER listened to the accusseds' side.

bai, i can understand your frustration about this whole thing, but you have to consider this: the appeals process in our country is the same as most other countries - a higher, appellate court reviews the decisions of the lower courts. if we were to have the supreme court try - all over again - all the cases that were appealed to it, then the justice system in this country will grind to a halt.

di sad ko maka sulti ana coz wala man ko'y personal knoweldge sa ila josman but if my "theory" should have its way mahulog gyud nga all or nothing unta to but with the controversy of this case the justice system and the pressure on the judge he cannot afford not to punish anybody. so lunod-patay na lang gyud, including Paco.

i understand but the problem with this case is the defense already lost this case before it even started. i personally believe that this case (not all cases in this country) should have a re-trial. the circumstances and old evidences suggests it should as well as the new evidences that are slowly being unearthed. for me a rape case is truly unique because the testimony of a victim alone is enough to convict the perpetrator.

technically, there are supervening events in the legal world. kapoy lang explain ron, hehe!!

on a personal note, all i can say is that luoy gyud si Paco bisan barumbado tong bataa they don't deserve to be on death row. he is a victim of circumstance.

no need to explain `pre... if i recall correctly, you mentioned some of those before, and i suppose i've said my piece on that. my comments above are just about how the legal system works in our country.

as for paco, we'll as i've posted before, i don't personally know either paco or the chiongs. but based on the guy's reputation, i'd say he's a victim of his past......as they say, what goes around, comes around.....
