Public Attorney's Office chief Percida Acosta on Saturday said she was convinced that policemen involved in the February 17 shootout along EDSA, Quezon City, did not rubout three suspected carjackers.
"Based on evidence, I’m convinced… Let us give the police officers involved in this case the benefit of the doubt,” Acosta told radio dzMM.
Acosta’s has been authorized by Justice Secretary Raul Gonzalez to provide free legal assistance to policemen -- with ranks from Police Officers 3 down to Police Officers 1 -- involved in the alleged rubout.
She said she was supposed to assign the case to lower ranking public attorneys, but later on decided to take on the case herself after hearing the statements and sentiments of eight members of the Quezon City Police District’s anti-carnapping (Ancar) unit.
The eight policemen were among the 29 cops ordered suspended by the National Police Commission for the alleged rubout.
“I can see how sensitive this case is, and they have been prejudged without their side being heard by the public,” Acosta said, adding that the policemen have been prejudged because of the ABS-CBN News footage, where policemen were seen shooting at the suspects inside a carjacked vehicle along EDSA near NIA Road last week.
She said she felt the “idealistic” policemen were telling the truth during the interview. “I interviewed them for hours and I can see it in their faces… they can look at me straight in the eye.”
She said that aside from the results of her interview with the Ancar members, forensic evidence showed that the policemen did everything by the rules and were careful enough to avoid civilian casualties during the operation.
Acosta said that based on PAO’s initial investigation, the three suspected carjackers identified as Rolando Batapa, Romeo de Guzman and Alfredo Pimentel were armed with a .22 revolver, .38 revolver and a .4 5pistol.
Contrary to public perception, she said that two of the successive shots heard from the ABS-CBN News footage came from Batapa’s gun.
Police Officer 2 Randy Barrameda, who was the first to approach the suspects’ vehicle, fired at Batapa and shot him to the left shoulder.
“When I looked at the autopsy report and consulted it with our forensic experts, Barrameda really just tried to incapacitate [the suspect] because [the suspect] was hit only in his left shoulder,” Acosta explained.
Batapa was rushed by policemen to a hospital, but expired at least a couple of hours later.
Acosta said if Barrameda really wanted to kill Batapa, he would not have shot him in the shoulder, adding that she was convinced the policeman only incapacitated the suspect.
Police identified themselves
She said that based on the accounts of the eight policemen, the suspects fired at them twice during the hot pursuit along EDSA in Cubao area.
She said the policemen pursuing the suspects were careful enough to decide not to fire back because at that time, around 7 p.m., there was heavy traffic in the area.
Acosta said the policemen patiently pursued the suspects’ car and decided to fire back at the NIA Road area, where a few vehicles are passing.
“Here you can see how careful the policemen were,” she said.
She added that the cops involved in the shootout properly identified themselves throughout the pursuit.
“They said they been shouting ‘Pulis kami’ in Cubao,” Acosta added.
Properly parked vehicle
Acosta also explained why the suspects’ vehicle was properly parked and its handbrake was locked as seen on the ABS-CBN News vide.
She said the driver of the stolen vehicle, stopped near NIA Road and abandoned his wounded gangmates and then boarded a back up Toyota Revo.
She said the policemen admitted pulling up the stolen vehicle’s handbrake, which, she said, is usually done during clearing operations.
Acosta also explained that the stolen vehicle’s window were close because the suspects could have been professionals.
“I had a gun training in Camp Crame and at the NBI (National Bureau of Investigation), they said if someone is assaulting me, I should not open my window and I can fireback [with windows closed],” the PAO chief said.
Acosta also said that some of the policemen involved in the operation were in civilian clothes because they did not have enough time to wear their uniforms.
“They were alerted by the Highway Patrol Group. They said they were in a hurry to respond and did not bother wearing their uniforms,” she said.
