There is nothing wrong with terminating agents who has indeed failed to reach the company's standard of performance. It is indeed management's prerogative to terminate employees who have indeed fallen short of the ESTABLISHED WORK STANDARDS of the company. But before you can claim of any standards that exists, it must be documented otherwise it's mere hearsay. That is the reason why we have the employee's handbook, employment contract and memos. This is to officially inform the employee what the company expects from the employee when they hired them. In the case of wats they were not able to show one iota of written document of the so called Performance Standards which they claim that the employees they terminated fell short of.
Moreover, the employees are entitled to due process of law and that does not only constitute of the two written notices that is required by the labor code. The infraction that they used against the agents were, that they had been falling below the STANDARD production rate for the past months. Therefore they have been found to be GROSSLY INEFFICIENT and were terminated. But before an employee can be considered GROSSLY INEFFICIENT there must be a trail of inefficiencies that was committed in the past and all of these are duly documented.
How come they can't come up with any document to prove that these employees had been Reprimanded IN WRITING or SUSPENDED for being INEFFICIENT. You know why? because the PERFORMANCE STANDARDS with regard to PRODUCTION RATE NEVER EXISTED. And they thought that they can just make it up and get away with it.
When they recruited people in the nearby provinces they advertised it as a low stress job with great pay, NO QUOTAS!!!! So was that all a deception? because it came from the past company president himself. Of course not! because it was really true. Only when there was a change in management that they thought, they can just change things without informing the employees in writing(which by the way was in the employment contract that they were to inform the employees in writing of any changes in policy). If those who took over were just thinking with their heads instead of their butts (who by the way arubinkun loves to kiss) they could just have issued a memo stating that these are the new policies(no matter how oppressive it may be). Then issue written reprimands and suspensions left and right and get away with murder. Agents would have resigned by the hundreds without effort and it would not cost them a cent.
Since they were not able to get away with it they devised another scheme the forced, six months leave without pay. Under our labor laws the company can temporarily suspend operation due to economic reasons. But you cannot just pick employees and force them to go on long unpaid leaves while you continue to operate. This is another circumvention of the law. But it seems that they have gotten away with it because those that were subjected to this did not put up a fight(or people from DOLE just turned a blind eye how much was the cashonduan kaya?).
Well I can't blame these neophytes they just know what to do. I guess they just have to move on and I just pray that these people who are responsible for these injustices will soon have their day and for everybody to see. That's what you call Karma man.
