SENATOR Miriam Defensor Santiago yesterday cautioned her colleagues not to hit back by using the power of contempt against Cabinet and military officials who earlier stayed away from congressional hearings because of Executive Order 464.
Senator Rodolfo Biazon, meanwhile, suggested that Palace officials and senators meet to establish common ground with respect to their interpretation of the Supreme Court ruling on EO 464 to prevent a full-blown confrontation.
Last week, the Supreme Court declared as unconstitutional a provision in EO 464 that required executive department officials to obtain presidential consent before testifying in Congress.
Senators had challenged EO 464 before the tribunal, arguing that it impinged on their power to write laws.
“Congress should avoid impulsive retaliatory measures, such as citing for contempt absent Cabinet members, or abolishing budgetary appropriations of their departments. It is best to be patient because haste makes bad law,” Santiago said
.
Santiago said, however, that threats from several senators to aggressively use their power of contempt was to be expected because they viewed EO 464 as provocative.
“The EO angered and offended them,” she said.
Santiago, an expert in constitutional law, said the recent Supreme Court ruling on EO 464 represents a continuation of legal tradition concerning the legislative power to investigate and the President’s power to invoke executive privilege.
“The Supreme Court tried to avoid a head-on collision by suggesting a compromise, meaning a narrow construction. It steered both political branches of government toward an acceptable accommodation,” she said.
Biazon, for his part, stressed that both the Senate and the Palace should maintain “a certain amount of civility.”
“If we want to make institutions and institutional processes work, there must be a common ground and this common ground should include interpretation of different national policies,” Biazon said.
He noted that the Palace and several members of Congress have different interpretations of the Supreme Court decision, so the parties should try to come up with a common understanding.
Biazon said his committee would resume hearings on the alleged poll fraud and wiretapping on May 17, shortly after the Senate resumes its session. With Joyce Pangco Pañares and Macon Ramos Araneta
