Yes there is no problem there with DX9.

Actually tested the game in DX10 mode. No patch and no errors.
Using HD3870. Windows vista SP1 (DX10.1)

Amazing stunning graphics this game has.
Although the gameplay is like splinter cell combined with Price of Persia. Hehe.
