anyway, 1 factor na dapat i-consider sa amount nga gi-demand is the filing fees. dili dawaton imong complaint kung wala'y bayad. of course speculation ra ni on my part, pero i'm sure nga ang filing fees gi-consider na sa pagdecide kung pila ang demanda. although pwede man ma waive ang filing fees, kinanglan mo apply pa ka to file the case as a pauper litigant. ambot kung ni-apply ba ang complainant.

kung sa legal aspect lang, IMO, the "victim" has a cause of action against the doctors, etc. for moral damages. actually sayon raman i-identify ang victim - hospital records: on Xdate, a patient with the name of Y was operated on to remove the canister. all the victim needs to do that he is patient Y. obviously, dili man maka deny ang hospital nga diha silay patient with that medical condition.

as for whether or not dako ra ba ang P6M, well, i really can't say. moral damages are "incapable of pecuniary estimation", so generally, whatever amount you claim for that depends on what you think should be due to you. but as i said earlier, you also have to consider the filing fees bec. that depends on the amount of your claim. whether the court will award the P6M is an entirely different story; by and large, courts are not generous when it comes to moral damages bec. the "reasonableness" of the award is considered; of course what is "reasonable" will depend on the circumstances and the proof....

yup, u r ryt. i also heard about moral damages as "incapable of pecuniary estimation". so sa korte na gyud ni mag daug.

there was a news yesterday that the CVC law firm won a 5M libel suit against The Tribune publisher Niñez Cacho Oliveros. Other than the 5M, Oliveros will also be imprisoned from 6 months to 2 yrs.

i guess ing ani na gyud cguro ang range sa moral damages if dako na ang scope.
